A third lawsuit has been filed against Dalton Foundries Inc. and Warsaw Engineering and Fabricating Inc. in less than a week.
In a case filed Thursday in Kosciusko Circuit Court, Norma J. Wood, individually and in her capacity as the personal representative of the estate of Terry G. Wood, is seeking judgment "in amount commensurate with the injuries and damages suffered" as a result of Terry Wood's death.
Terry Wood of Warsaw was one of three Dalton employees who died as a result of injuries suffered in an explosion at the foundry on June 22, 1995. Wood succumbed to his injuries on June 29, 1995.
Also killed was John Parker of Larwill, whose widow filed a similar lawsuit last week, and Robert Wells of Pierceton. More than a dozen other workers were injured, including Rodger Darnell of Huntington, who has also taken court action against the corporations.
As in the other cases, Wood's case - filed by Charles R. Waggoner of Lightfoot & Waggoner - alleges that modifications were negligently made to the furnace in which a series of explosions occurred on June 22, 1995.
Additionally, this case also doesn't state a specific amount to compensate for the losses resulting from Wood's death.
In a related case, a wrongful death claim was filed last year in Wood's estate, which is also a pending matter.
