You are hereby notified that you have been made a part in the Kosciusko Circuit Court by a complaint filed by the plaintiff, MutualBank, the title of the case as shown by the complaint and the cause number assigned thereto being as set forth. The nature of the above-designed suit is for the recovery of moneys due the plaintiff on certain promissory notes and for the foreclosure of certain real estate mortgages given as security for said notes. This summons by publication and notice is specifically directed to Timothy Smith, Brian Scott Smith, Tharon C. Smith III, Heidi R. Smith, Heather Smith-Barhydt and Seth Smith and the unknown heirs, devisees, Personal Representatives, successor and assigns for the Estate of James H. Bassett, who cannot be determined or found within or outside the State of Indiana. You or your attorney on your behalf must respond to the above-entitled action by answer or other response to the plaintiff's complaint against you, within thirty (30) days after the third and last publication of this notice, and if you fail to do so, a judgment by default may be entered against you for the relief demanded in said complaint.
