ALL PERSONS WHO ASSERT OR MIGHT ANY TITLE, CLAIM, OR INTEREST IN AN ABANDONED RAILROAD SPUR DESCRIBED IN THIS COMPLAINT, THE NAMES OF WHOM ARE UNKNOWN TO THE PLAINTIFFS, Defendants

    To: All Persons who may assert a claim or right or interest in or to certain real estate in Kosciusko County located in the vicinity of 515 Glessner Street, Warsaw, Indiana, more particularly being an abandoned railroad right-of-way which crosses parts of Lots 46, 45, and 44 in Lakeside Park Addition to the City of Warsaw, in Kosciusko County, Indiana.
    You are hereby notified that on the 2nd day of August, 2016, the above-named Plaintiffs, Tim E. Lowman a/k/a Tim Lowman and Carla Marie Lowman a/k/a Marie Lowman, by their attorneys, Rockhill Pinnick LLP (Richard K. Helm), 105 East Main Street, Warsaw, IN 46580, have filed in the Office of the Clerk of the Kosciusko Superior Court No'. 1, Kosciusko County, Indiana, their Complaint to Quiet Title to certain real estate situate in Kosciusko County, Indiana, more particularly described as follows:
    PARCEL I: LOTS NUMBERED 46, 47, 48 AND 49, TOGETHER WITH THE SOUTH HALF OF A VACATED 12 FOOT ALLEY ADJACENT TO AND NORTH OF SAID LOT 46 AND THE EAST HALF OF A VACATED 33 FOOT ROADWAY (ELLSWORTH STREET) ADJACENT TO AND WEST OF SAID LOTS; LESS AND EXCEPTING A 24 FOOT RAILROAD SPUR LINE, ALL BEING IN LAKESIDE PARK ADDITION TO THE CITY OF WARSAW, AS RECORDED IN PLAT BOOK 1, PAGE 29 IN THE OFFICE OF THE RECORDER OF KOSCIUSKO COUNTY, INDIANA.
    PARCEL II: LOTS NUMBERED 44 AND 45, TOGETHER WITH THE NORTH HALF OF A VACATED 12 FOOT ALLEY ADJACENT TO AND SOUTH OF SAID LOT 45 AND THE EAST HALF OF A VACATED 33 FOOT ROADWAY (ELLSWORTH STREET) ADJACENT TO AND WEST OF SAID LOTS, LESS AND EXCEPTING A 24 FOOT RAILROAD SPUR LINE, ALL BEING IN LAKESIDE PARK ADDITION TO THE CITY OF WARSAW, IN KOSCIUSKO COUNTY, INDIANA.
    And more particularly the abandoned railroad spur line which crosses a part of Lots 46, 45, and 44, described above.
    This action is instituted and prosecuted by the Plaintiffs for the purpose of quieting title to the above-described real estate as against any and all of the named Defendants, any and all claims, and any and all claimants, known or unknown, whatsoever and whomsoever, and as against the world.
    You and each of you, or your respective attorneys on your behalf, must respond to the Complaint by answer or other response thereto on or before the 23rd day of September, 2016, the same being more than 30 days after the third and last publication of this notice. If you fail to do so, the matters and things alleged in the Plaintiffs' Complaint may be taken as true and a judgment by default may be entered against you for the relief demanded in the Complaint.
