Wood and S. Elaine Wood, by their attorneys, Rockhill Pinnick LLP (Richard K. Helm), 105 East Main Street, Warsaw, IN 46580, have filed in the Office of the Clerk of the Kosciusko Superior Court No. 1, Kosciusko County, Indiana, their Complaint to Quiet Title to certain real estate situate in Kosciusko County, Indiana, more particularly described as follows: Part of the Southwest Quarter of Section 15, Township 32 North, Range 6 East, Kosciusko County, Indiana, more particularly described as follows, to wit: Commencing at a Mag spike found at the Southeast corner of Lot Number 186 in the Original Plat of Winona Park, now the Incorporated Town of Winona Lake, Kosciusko County, Indiana; thence N71º-11'-55"E (GPS bearings were used as the basis of bearings for this description), on and along the Easterly projection of the Southerly line of said Lot Number 186, a distance of 20.11 feet to a point on the Easterly right-of-way line of Grace Avenue, said point being at the POINT OF BEGINNING; thence N14°-52'-56"W, on and along said Easterly right-of-way line, a distance of 2.90 feet to an iron pin found at the point of intersection with the Northerly face of the existing concrete steps; thence N83°-29'-05"E, on and along the Northerly face of said concrete steps, a distance of 58.19 feet to a Mag nail on the top of an existing timber retaining wall, said Mag nail being situated 10.0 feet West of the West line of Lots Numbered 160 and 161 in the Original Plat of Winona Park, now the Incorporated Town of Winona Lake; thence S00º-40'-03"W, a distance of 7.64 feet to a 5/8-inch iron pin capped "Walker" on the Easterly projection of the North line of a certain tract of land as recorded in Document Number 200500011241 in the records of Kosciusko County, Indiana; thence S83°-48'-39"W, on and along said Easterly projection and on and along said Northerly line, a distance of 56.16 feet to a 5/8-inch iron pin capped "Walker" at the Northwest corner of said tract of land in Document Number 200500011241, said iron pin also being on the Easterly right-of-way line of Grace Avenue; thence N14°-52'-56"W, on and along said Easterly right-of-way line, a distance of 4.44 feet to the point of beginning, containing 0.010 acres of land, more or less, subject to all legal right-of-way, subject to all legal drainage easements and all other easements of record. This action is instituted and prosecuted by the Plaintiffs for the purpose of quieting title to the above-described real estate as against any and all of the named Defendants, any and all claims, and any and all claimants, known or unknown, whatsoever and whomsoever, and as-against the world. You and each of you, or your respective attorneys on your behalf, must respond to the Complaint by answer or other response thereto on or before the 6th day of April, 2015, the same being more than 30 days after the third and last publication of this notice.
