YOU ARE HEREBY NOTIFIED that on the 24th day of November, 2018, the above-named Plaintiffs, by their attorney, Chad M. Miner (#26496-43), Miner & Lemon, LLP, 313 South Buffalo Street, Warsaw, Indiana 46580, and with telephone number 574-268-9911, filed in the Office of the Clerk of the Kosciusko Circuit Court, Kosciusko County, Indiana, their Complaint, which Complaint was in regards to a certain Land Sale Contract entered into by and between Leonard Franklin Goble and Linda Kay Goble and Dale Zimmerman and Nancy Zimmerman on the 16th day of January, 2015, and which Complaint (along with the said contract) was also in regards to real estate commonly known as 112 North Scott Street, Warsaw, Indiana 46580 and legally described as follows:
Forty feet off the North end of the following described tract, being Forty feet North and South and Fifty-Six feet East, and West; Commencing at the Southwest corner of Lot Number One in Boss’ Addition to the Town, now City of Warsaw, running thence East Fifty-Six feet; thence North One Hundred Sixteen feet; thence West Fifty-Six feet; thence South One Hundred Sixteen feet to the Place of Beginning.
Also, commencing 72 feet North of the Southwest corner of Lot Number One in Boss’ Addition to the Town, now City of Warsaw; running thence North 4 feet; thence East 56 feet; thence South 4 feet; thence West 56 feet to the Place of Beginning.
The nature of the suit is based upon the Plaintiffs’ prayer for judgment that Dale Zimmerman and Nancy Zimmerman have breached the aforesaid contract, that Dale Zimmerman and Nancy Zimmerman have abandoned the aforesaid real property and that they have failed to make payment of more than a minimal amount against the principal balance due under said contract and with respect to said real property, and that any interest that Dale Zimmerman or his unknown heirs and Nancy Zimmerman may attempt to claim in said real property should be forfeited and that title thereof should be restored to Leonard F. Goble and Linda K. Goble free of any claim or interest that Dale Zimmerman or his unknown heirs and Nancy Zimmerman may assert with respect thereto.
You must respond to the Complaint on or before the 31st day of January, 2019, the same being more than 30 days after the third and last publication of this notice, and if you fail to do so, judgment by default may be entered against you for the relief demanded in the Complaint.
