You are hereby notified that on the 31st day of October, 2018, the above-named Plaintiffs, by their attorney, Kehler Law Firm (Christopher D. Kehler), 208 West Fort Wayne Street, Warsaw, Indiana 46580, filed in the Office of the Clerk of Kosciusko Superior Court 1, Kosciusko County, Indiana, his Complaint to Quiet Title to certain real estate situate in Kosciusko County, Indiana, more particularly described as follows:
TRACT 1: Part of the Plat of Rosnagle-Camden Addition to Arrowhead Park, Kosciusko County, Indiana (This description prepared by Kevin R. Michel, LS80870006, as part of original survey QU-149 completed by J.K. Walker and Associates, P.C., dated September 11, 2018), being more particularly described as follows, to wit:
Commencing at an iron pin found at the Northeast comer of Lot Number 27 in said Rosnagle-Camden Addition; thence S83°-31'-56"W (GPS Grid bearing and used as the basis of bearings for this description), on and along the North line of said Lot Number 27, also being on and along the South right-of-way line of EMS C19 Lane, a distance of 136.20 feet (planed 135 feet), to an iron pin found at the Northwest corner of said Lot Number 27, said iron pin being at the POINT OF BEGINNING; thence continuing S83°-31'-56"W, on and along the Westerly projection of said Lot Number 27, also being on and along said South right-of-way line, a distance of 20.96 feet to a 5/8-inch iron pin capped "Walker"; thence S07°-07'-08"E, a distance of 41.60 feet to the South face of an existing concrete seawall; thence N78°-09'-22"E, on and along said South face, a distance of 22.82 feet; thence SI 6°-02'-22"E, on and along a Westerly face of said concrete seawall, a distance of 100.11 feet to a joint in said concrete seawall, said joint being on the Westerly projection of the South line of Lot Number 26 in said Rosnagle-Camden Addition; thence N78°-16'-51"E, on and along said Westerly projection, a distance of 09.50 feet to the Southwest corner of said Lot Number 27; thence NI4°-37'-47"W, on and along the West line of said Lots Numbered 26 and 27, a distance of 139.50 feet to the point of beginning, containing 0.027 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and all other easements of record.
TRACT II: Part of the Plat of Rosnagle-Camden Addition to Arrowhead Park, Kosciusko County, Indiana (This description prepared by Kevin R. Commencing at an iron pin found at the Northeast comer of Lot Number 27 in said Rosnagle-Camden Addition; thence S83°-3 1'-56"W (GPS Grid bearing and used as the basis of bearings for this description), on and along the North line of said Lot Number 27, also being on and along the South right-of-way line of EMS C19 Lane, a distance of 136.20 feet (platted 135 feet), to an iron pin found at the Northwest comer of said Lot Number 27; thence continuing S83º-31'-56" W, on and along the Westerly projection of said Lot Number 27, also being on and along said South right-of-way line, a distance of 20.96 feet to a 5/8-inch iron pin capped "Walker" at the POINT OF BEGINNING; thence S07°-07'-08"E, a distance of 41.60 feet to the South face of an existing concrete seawall; thence S79°-38'-26"W, on and along said South face, a distance of 34.24 feet; thence S14°-091- 30"E, on and along the East face of said concrete seawall, a distance of 20.67 feet to the point of intersection with the Easterly projection of the South line of Lot Number 8 in said Rosnagle-Camden Addition; thence N85°-49'- 30"W, on and along said Easterly projection, a distance of 5.07 feet to a 5/8-inch iron pin capped "Walker" found at the Southeast comer of said Lot Number 8; thence N100-09'-14"W, on and along the East line of said Lot Number 8, a distance of 63.60 feet (recorded 64 feet), to an iron pipe found at the Northeast corner of said Lot Number 8, said iron pipe being on the South right-of-way line of EMS C19 Lane; thence N83°-31'-56"E, on and along said South right-of-way line, a distance of 40.00 feet to the point of beginning, containing 0.040 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and all other easements of record.
This action is instituted and prosecuted by the Plaintiffs for the purpose of quieting title to the above-described real estate as against any and all named Defendants, claims, and claimants, whatsoever and whomsoever, and as against the world.
You and each of you, or your respective attorneys on your behalf must respond to the Complaint by answer or other response thereto on or before the 18th day of December, 2018, the same being more than 30 days after the third and last publication of this notice. If you fail to do so, the matters and things alleged in the Plaintiffs' Complaint may be taken as true and a judgment by default may be entered against you for the relief demanded in the Complaint.
