DIAZ, defendants KOSCIUSKO CIRCUIT COURT 2011 CALENDAR TERM CAUSE NO. 43C01-1101-MF-1 The State of Indiana to the defendants above named, and any other person who may be concerned. You are hereby notified the Defendants, Doyle E. Diaz, Christine Diaz-Mederios; and All Heirs and Claimants Known and Unknown of Cathleen W. Diaz, are being sued by First Federal Savings Bank in the above captioned matter in the Kosciusko Circuit Court, Kosciusko County, State of Indiana. The nature of the suit is a civil action wherein the plaintiff has filed a Complaint on a Promissory Note and to Foreclose A Mortgage demanding judgment on a promissory note and the foreclosure of a mortgage on the defendant at the property located at 8103 East Wade Lane, North Webster, Indiana, 46555, in Kosciusko County, Indiana which property is more particularly described as follows to-wit: Lot 20 in Block D in the Revised Plat of Epworth Forest as platted in Section 11, Township 33 North, Range 7 East, as recorded in Plat Book 2, pages 258 and 259 in the Office of the Recorder of Kosciusko County, Indiana. MORE COMMONLY KNOWN AS: 8103 East Wade Lane, North Webster, Indiana 46555. This Summons by Publication and Notice is specifically directed to the Defendants, All heirs and Claimants Known and Unknown of Cathleen W. Diaz, whose whereabouts are unknown. You must answer or otherwise respond to the Complaint in writing, by you or your attorney, on or before the 14th day of February, 2011, and in case you fail to do so, Judgment by Default may be entered against you for the relief demanded by the plaintiff in the Complaint. If you have a claim for relief against the plaintiff arising out of the transaction of occurrence that is the subject to the plaintiff's claim, you must assert it in your written answer.
