Suit Filed Over Verizon Tower

A civil suit was filed against Verizon Wireless last week by property owners adjoining the Atwood 0403 cellular tower.

The property owners claim the tower is causing problems for them and that Verizon has remained unconcerned.

Kelli and Chris Faulkner, 2234 N. CR 700W, Warsaw, claim in their lawsuit that since Verizon has operated the tower, they have endured electrical problems of all sorts at their residence, including demolished appliances, lighting issues and loud electrical disturbances.

Verizon took over operation of the tower from Sprint.

As these occurrences have become prevalent the Faulkners' insurance has refused to cover any more claims related to electrical or lighting issues. If they file another claim regarding these disturbances, their policy will be dropped, the suit says.

In their suit, filed July 2 in Kosciusko Circuit Court, the Faulkners ask for an injunction preventing Verizon's electrical surges from leaving Verizon property. They also asked for damage repayment for their personal property and for compensation for the non-insurable and non-sellable state they claim their home is now in. No monetary amount was specified.

According to the Faulkners' attorney, Richard K. Helm, the family has repeatedly attempted to contact Verizon and settle the problem out of court and in a friendly manner. They have sent letters to Verizon explaining the problem and when that failed, have tried to reach company officials, but have received no response.
