The surviving spouse of a man electrocuted two years ago at Royal Crown in Milford is seeking compensation for her losses.
Wesley Prater, 22, of Warsaw, died June 14, 2000, when he was electrocuted while working on a filter system at the business.
A lawsuit was filed recently in Kosciusko Superior Court I by Melissa Prater against Nucon International Inc. , the manufacturer of the filter system, and Kendall Electric Inc., the company that sold the system to Royal Crown. Royal Crown is not named as a defendant in the case.
Among other allegations, according to court documents, Nucon negligently designed, manufactured and assembled the filter system, "making it dangerous and unsafe for its intended use."
The lawsuit also claims that Kendall Electric breached its duties by failing "to properly inspect the aforementioned filter system before placing it in the stream of commerce" and failing "to provide adequate instructions for its use."
An unspecified monetary amount is sought in each of four counts in the lawsuit. Peter J. Agostino of Anderson, Agostino & Keller, South Bend, is the attorney for Melissa Prater.
