Ordinance 11-01-14 PARK REGULATIONS Section 1. Times Established for Use of Public Parks. a. The use and benefit of all of the public parks owned and operated by the town are for the general good and benefit of the residents of the town and that it is in the best interests of such residents that times for the daily opening and closing of all of the parks is established. b. All of the parks owned and operated by the town shall be opened daily at sunrise and shall be closed daily at sunset, and that persons using, going into and upon, and being within each of the parks shall be only between the hours of sunrise and sunset on each and every day except as herein otherwise provided. c. The time of sunrise and sunset for the purposes of this section shall be such times as fixed and specified daily by the appropriate bureau, department, or division of the United States government charged with the responsibility for so establishing the daily time of sunrise and d. The Town Council reserves the right and privilege to allow for the use of, and for persons, to go in and upon the premises of any of its parks at times other than specified herein after proper request therefor has been made to and approval thereof granted by the Town Council. e. Appropriate signs shall be posted and erected in each park giving notice of the terms and provisions of this section, and when such signs are posted and erected no person shall violate the terms and provisions hereof. f. Any person in violation of any of the terms and provisions of this section shall be considered and determined to have committed trespass upon the real estate owned by the town, and shall be charged accordingly with such offense. Section 2. Alcoholic Beverages Prohibited in Town Parks-Penalty. g. Except as specifically provided for by a permit issued by the Silver Lake Town Council, under such terms and procedures as adopted by the Town Council from time to time, the possession, use, or consumption of alcohol, malt, or vinous beverages in any form or manner whatsoever is prohibited and forbidden in all Town Parks. h. Appropriate signs shall be posted and erected in each park giving notice of the terms and provisions of this section, and when such signs are posted and erected no person shall violate the terms and provisions hereof. i. Any person in violation of any of the terms or provisions of this ordinance shall, upon conviction thereof, be fined in an amount of not less than ten dollars ($1 0.00) nor more than fifty dollars ($50.00). Any person charged with a violation of this ordinance may, in lieu of being charged for such violation in Court for the penalties prescribed herein, pay to the Clerk-Treasurer of the Town of Silver for the benefit of the General Fund of Said Town, within thirty (30) days after being charged with any such violation, the sum often dollars ($10.00) for each such violation if paid within five (5) days of the violation, or if such sum has not been paid within said five (5) days, then by paying the sum of ten dollars ($10.00) plus an additional one dollar ($1.00) for each day from the time of the violation charged to date of payment, with such total sum not to exceed twenty-five dollars ($25.00). Section 3. Parking Regulations-Penalties. j. The type of vehicles to be parked at designated locations at the parks of the Town of Silver Lake shall be determined by and at the discretion of the Town Marshal of the Town of Silver Lake. k. The locations designated by the Town Marshal for parking vehicles, and the type of vehicles to be parked at such designated locations, shall be determined after giving full and complete consideration to creating the maximum number of parking spaces which can be used in an orderly manner while attaining the greatest safety for the benefit of the general public. l. Appropriate signs shall be erected at each parking location at said parks designating the type or other reasonable identification of vehicles allowed to be parked in accordance with the provisions of this ordinance, and such signs shall be in place at the time of any alleged offense. m. Vehicles parked in violation of the terms and provisions of this ordinance may be towed from the within described parking locations at the expense of the owner thereof or the person in possession thereof. n. Any person in violation of any of the terms or provisions of this ordinance shall, upon conviction thereof, be fined in an amount of not less than ten dollars ($10.00) nor more than fifty dollars ($50.00). Any person charged with a violation of this ordinance may, in lieu of being charged for such violation in Court for the penalties prescribed herein, pay to the Clerk-Treasurer of the Town of Silver for the benefit of the General Fund of Said Town, within thirty (30) days after being charged with any such violation, the sum of ten dollars ($10.00) for each such violation if paid within five (5) days of the violation, or if such sum has not been paid within said five (5) days, then by paying the sum of ten dollars ($10.00) plus an additional one dollar ($1.00) for each day from the time of the violation charged to date of payment, with such total sum not to exceed twenty-five dollars ($25.00). Section 4. Additional Park Rules- Penalty o. Profanity and I or vulgar language is prohibited and forbidden in all Town Parks. p. No motorized vehicles, bicycles, or skateboards are permitted to travel in the parks outside the designated parking areas, with the exception of motorized wheel chairs. q. The discharge of firearms, archery equipment, or fireworks is prohibited and forbidden in all Town Parks. r. Glass Containers are prohibited and forbidden in all Town Parks. s. Fires are prohibited and forbidden in all Town Parks, other than while closely attended in designated fire pits or grills. t. Smoking is prohibited and forbidden on the basketball court, playground, or bleachers in all Town Parks. u. Except as specifically provided for by a permit issued by the Silver Lake Town Council, under such terms and procedures as adopted by the Town Council from time to time, all dogs are prohibited and forbidden in all Town Parks, with exception of certified service dogs in the performance of service duties. v. Except as specifically provided for by a permit issued by the Silver Lake Town Council, under such terms and procedures as adopted by the Town Council from time to time, the amplification of music is prohibited and forbidden in all Town Parks. w. Appropriate signs shall be posted and erected in each park giving notice of the terms and provisions of this section, and when such signs are posted and erected no person shall violate the terms and provisions hereof. x. Any person in violation of any of the terms or provisions of this ordinance shall, upon conviction thereof be fined in an amount of not less than ten dollars ($10.00) nor more than fifty dollars ($50.00). Any person charged with violation of this ordinance may, in lieu of being charged for such violation in Court for the penalties prescribed herein, pay the Clerk-Treasurer of the Town of Silver Lake for the benefit of the General Fund of Said Town, within thirty (30) days after being charged with any such violation, the sum of then dollars ($10.00) for each such violation if paid within five (5) days for the violation, or if such has not been paid within said five (5) days, then by applying the sum of then dollars ($10.00) plus an additional one dollar ($1.00) for each day from the time of the violation charged to date of payment, with such total sum not to exceed twenty-five ($25.00). This Ordinance shall be in full force and effect from and after its passage and approval by the Town Council and supersede any previous regulatory sign Ordinance pertaining to Poplar and Wells Streets.
