ORDINANCE NO. 05-01-09 AN ORDINANCE AMENDING ORDINANCE NO. 08-01-07 ANNEXING CERTAIN TERRITORY TO THE TOWN OF SILVER LAKE, INDIANA WHEREAS, The Town Council of the Town of Silver Lake, Indiana, ("Town") adopted Ordinance No. 08-01-07 on August 14, 2007, to annex certain territory to the Town; and, WHEREAS, Ordinance No. 08-01-07 will not become effective until July 16, 2010; and, WHEREAS, the Town has determined that Ordinance No. 08-01-07 should be amended to delete the real estate owned by Joseph Graham and Saundra Graham, commonly known at 406 North High Street, Silver Lake, Indiana 46982, and described as Parcel VII on Exhibit 1 of Ordinance No. 08-01-07 from the annexation. NOW, THEREFORE, BE IT ORDAINED, BY THE TOWN COUNCIL OF THE TOWN OF SILVER LAKE, INDIANA, AS FOLLOWS; 1. The following described parcel of real estate owned by Joseph Graham and Saundra Graham, commonly known as 406 North High Street, Silver Lake, Indiana 46982, is hereby disannexed and deleted from Ordinance No. 08-01-07, and which real estate is more particularly described as the following tracts of real estate located in Kosciusko County, Indiana, to-wit: Tract I: A tract of land located in the southwest Quarter of Section 5, Township 30 North, Range 6 East, Lake Township, Kosciusko County, Indiana, more particularly described as follows: Commencing at the West Quarter post of said Section 5; thence South, along the West line of said Section 5, 1338.15 feet (81 rods, 2.5 links recorded) thence East, 196.5 feet (recorded) to an 8-inch concrete post; thence North 90 degrees 00 minutes 00 seconds East, 146.08 feet (146.5 feet recorded) to a 5/6-inch iron bar and the point of beginning; thence North 01 degrees 58 minutes 53 seconds East, 270.97 feet to a 5/8-inch iron bar; thence South 89 degrees 48 minutes 46 seconds East, 20.20 feet to a 5/8 inch iron bar; thence North 29 degrees 29 minutes 15 seconds East, 107.55 feet to a 5/8-inch iron bar; thence North 46 degrees 34 minutes 56 seconds West, 6.04 feet to a railroad rail post; thence South 89 degrees 47 minutes 54 seconds West, 256.38 feet to a railroad rail post; thence North 04 degrees 32 minutes 16 seconds West along a fence line 664.54 feet to a railroad rail post; thence North 88 degrees 09 minutes 53 seconds East along a fence line, 496.03 feet to a railroad rail post; thence South 03 degrees 30 minutes 01 seconds East, along a fence line, 703.61 feet to a 1/2-inch iron bar; thence North 88 degrees 00 minutes 08 seconds East, 136.93 feet to a 1/2-inch bar; thence South 01 degree 39 minutes 11 seconds West, 265.23 feet to an 8 inch Wood Post; thence South 87 degrees 17 Minutes 00 Seconds West, 237.74 feet to an 8-inch wood post; thence South 03 degrees 48 minutes 41 seconds East, 23.18 feet to a 1/2-inch iron bar; thence South 86 degrees 59 minutes 06 seconds West; 188.44 feet to a 1/2-inch iron bar; thence South 04 degrees 44 minutes 03 seconds East, 39.65 feet to a railroad spike on the Easterly line of High Street; thence North 88 degrees 10 minutes 38 seconds West, 16.29 feet to the point of beginning. TRACT II: A tract of land located in the Southwest Quarter of Section 5, Township 30 North, Range 6 East, Lake Township, Kosciusko County, Indiana, more particularly described as follows to wit: Commencing at the West Quarter post of said Section 5; thence South, along the West line of said Section 5, a distance of 1338.15 feet (recorded 81 rods, 2.5 links); thence East, a distance of 196.5 feet to a 8-inch concrete post; thence North 90 degrees 00 minutes 00 seconds East, a distance of 146.08 feet (recorded 146.5 feet) to an 5/8-inch iron bar; thence South 88 degrees 10 minutes 38 seconds East, a distance of 16.29 feet to a railroad spike on the Easterly right-of-way line of High Street, said railroad spike being the true point of beginning; thence North 04 degrees 44 minutes 03 seconds West, a distance of 39.65 feet to a P.K. nail found; thence North 86 degrees 59 minutes 06 seconds East, a distance of 50.0 feet; thence South 04 degrees 44 minutes 03 seconds East, parallel to the East right-of-way line of High Street, a distance of 89.65 feet; thence South 86 degrees 59 minutes 06 seconds West, a distance of 50.0 feet to a point on the East right-of-way of said High Street thence North 04 degrees 44 minutes 03 seconds West, on and along said East right-of-way line a distance of 50.0 feet to the true point of beginning.
