ORDINANCE NO. 2010-12 Set Backs and Lot Requirements For the Town of Sidney, Indiana Section 1. Any person, persons, or corporations planning on building a new structure, or adding a new structure to the original structure, such as decks, Garages, Carports, Garden Shed, shall make application to the Town Council, giving them size and location of the project. Section 2. Any new structure that will be used as a single family dwelling shall have a foundation under the home. That includes : Manufactured homes. If it is a trailer, Single or Double Wide, it will conform to all specifications spelled out in Ordinance No 1992-2. Section 3. Lot and yard requirements: Minimum Depth of Front Yard - 20 Feet Minimum Depth of Rear Yard - 10 Feet Minimum Depth of Yard Lot Width Set Back Less than 75 feet No less than five (5) feet 75 feet to 85 feet No less than Seven & One Half (7.5) feet Greater than 85 feet No less than (10) feet Lots which abut on more than one right-of way, thoroughfare and/or access easement shall provide the required front yards along every right-of-way, thoroughfare, and/or drainage easements. No portion of any structure, whether open or enclosed, including Garages, Porches, Carports, Balconies, Roofs or Platforms above normal grade level shall project into any minimum front, side, or rear yard. Section 3. Building permits are required for any structure. The permit will be good for a period of (6) months, after that you will have to renew the permit. Section 4. Violations And Penalties: Any structure or use that violates this ordinance shall be deemed to a public nuisance, and the owner, lessee, agent Or contractor as the case may be, shall be liable for maintaining a public nuisance. Any person who violates any provision of this ordinance shall be guilty of an ordinance violation and upon conviction, shall be fined not less than ten dollars (10.00) and not more than three hundred dollars (300.00) each day the violation continues or occurs shall constitute a separate offense. Any enforcement action may be instituted in the name and against the owner and/or the party actually responsible for the violation of this ordinance.
