By virtue of a judgment and decree of foreclosure, a copy of which has been duly issued, certified and to me directed by the Clerk of the Kosciusko Circuit Court in the certain cause bearing Cause Number 43C01-1704-MF-000033 upon the docket of said Court, wherein Mutual Bank is the plaintiff and Todd Wilson Slabaugh and Davi Lee Slabaugh are the defendants, requiring me to make the sum of Sixty-Four Thousand Twenty-Two Dollars and 611100 ($64,022.61) for payment of the judgment of said plaintiff against the defendants, Todd Wilson Slabaugh and Davi Lee Slabaugh, with interest thereon from the date of said decree, namely, January 19, 2018, at the rate and with costs provided by law as therein provided and ordering the sale of real estate hereinafter described to make assets for the payment of said judgment and decree, I will expose and offer for sale at public auction to the highest bidder on Tuesday, the 22nd day of January, 2019 at the hour of 10:00 o'clock a.m.,E.S.T., at the Office of the Sheriff of Kosciusko County, 221 W. Main St., Warsaw, Indiana, 46580, the following-described real estate situate in Kosciusko County, Indiana, to-wit:
TRACT I:
A tract of land within the limits of the Town of Etna Green, Indiana, beginning Twenty (20) feet East and Thirty (30) feet North of the intersection of the centerline of Federal Road Thirty (30) and the North and South half section of Section Twenty-seven (27), Township Thirty-three (33) North, Range Four (4) East, and East 234.7 feet following the North line of said road for a Place of Beginning; running thence North Seventy three (73) feet; thence East One Hundred (100) feet; thence South Ninety-five (95) feet; thence in a Northwesterly direction on the North line of said Road Number Thirty (30) 102.5 feet to the Place of Beginning.
TRACT II:
Also, commencing at a point Fifty-nine and One-half (59 1/2) rods South and Three Hundred Sixty-four and One-half (364 1/2) feet East of the center of Section Twenty seven (27), Township Thirty-three (33) North, Range Four (4) East, and running thence West One Hundred (100) feet; thence South Seventy-four and Twenty-five Hundredths (74.25) feet; thence East One Hundred (100) feet; thence North Seventy four, and Twenty-five Hundredths (74.25) feet to the Place of Beginning; said described tract being the West half (112) of the East Two Hundred (200) feet of that tract of land conveyed to Cora A. Nail found at the northwest corner of said southeast quarter; thence south, on and along the west line of said southeast quarter, a distance of 981.75 feet (recorded 59 1/2 rods); thence east, and on and along a line being established by existing monuments found, a distance of 264.5 feet to a 5/8-inch iron pin capped "Walker" at the northeast corner of a certain tract of land as recorded Document Number 9-12-0186, in the records of Kosciusko County, Indiana, said iron pin being at the true Point of Beginning; thence continuing east, on an along said line, a distance of 100.0 feet to a 5/8-inch iron pin capped "Walker"; thence southerly, by and interior of 89 degrees 49 minutes, a distance of 169.25 feet to a 5/8-inch iron pin capped "Walker"on the northerly right-of-way line of Old US Highway Number 30; thence westerly by an interior angle of 77 degrees 57 minutes 33 seconds, on and along said northerly right-of-way line, a distance of 102.25 feet (recorded 102.5 feet) to an iron bar at the southeast corner of said tract of land in Document Number 99-12-0186; thence northerly, by an interior angle of 102 degrees 02 minutes 27 seconds, on and along the east line of said tract of land in Document Number 9-12-0186, a distance of 147.6 feet (recorded 147.25 feet) to the true point of beginning, per survey to contain 0.36 acres, more or less.
