Septic Systems Concerns Prompt Rezoning Denial

Of the nine petitions before the Kosciusko County Area Plan Commission Wednesday, one was denied.

Two were continued to the February meeting and the remaining six were approved.

Denied was Thomas and Sandra Tough's petition to rezone six acres from an agricultural to a residential district. The property is on the west side of CR 800W in Seward Township. On rezonings, the plan commission is only a recommending body to the county commissioners, who will hear the petition Jan. 28 at 9:30 a.m. in the county courthouse, Warsaw.

Plan Commission director Dan Richard said the Toughs' property is as far south in Kosciusko County as one can get and still be in the county. There is a home on the property now at the southernmost end. The problem with the property is that most of the land is muck ground, he said, and the county health department has concerns about a septic system for a second home on the ground.

Sandra Tough said the second mobile home they plan to put on the property will be closer to the lake. She said she thought the ground was too low for a second mobile home but this was her husband's project and she really doesn't know much about it.

Due to the soil limitations, septic system concerns and high water level, county surveyor and plan commission member Richard Kemper made a motion to recommend to the commissioners to deny the petition, and it was unanimously denied.

In other business, the plan commission:

• Approved the final replatting of Shadow Lakes Estates, off old U.S. 30, Warsaw. The change to the platting included enlarging all lots and taking out three lots so there are 16 lots instead of 19. One easement was removed completely and another was moved.

• Approved Russel Fahl's petition for a preliminary plat for a residential development on 2.4 acres. The property is on the north side of Old Road 30E and 600 feet east of CR 300E in Wayne Township. Fahl told the board they want to sell the buildings on the property and just have farm ground left.

• Continued Gary and Mary Baker's petition to rezone ground from an agricultural to a residential district. The property is on the north side of CR 500N and 480 feet east of Ind. 13 in Tippecanoe Township. Gary Baker requested the commission table his petition while he looks at other options for his property so he can have two horses on it.

• Approved Edd Allen's petition for a preliminary plat residential development on 3.907 acres. The property is on the south side of CR 1250N and on the east side of CR 900E in Turkey Creek Township.

• Approved Dean Greene's petition for a preliminary plat for a residential development on 8.233 acres. The property is on the east side of EMS B26 Lane in Plain Township.

• Approved Dave Carey's petition to rezone half of a lot from residential to commercial district. The property is on the west side of Esterbrook Drive in Tippecanoe Township. The North Webster town council will hear the rezoning for final approval Jan. 16 at 6 p.m. in their town hall.

They also approved Carey Realty's petition for a preliminary plat for a residential development on 9.6 acres. The property is on the northeast side of Main Street in Tippecanoe Township.

• Continued Debra Thompson's petition for a preliminary plat for a commercial subdivision on 9.461 acres. The property is on the west side of Ind. 13 in Tippecanoe Township.

Members of the plan commission present Wednesday included Charlie Haffner, Vic Virgil, Don Arms, Kevin McSherry, Dick Kemper and Kelly Easterday. Not present were Hal Strong, Norm Lovell and Barb Carwile. They meet at 1 p.m. in the county courthouse, Warsaw, on the first Wednesday of every month. Due to the New Year's holiday this month, they met Wednesday instead.
