A motion to dismiss prosecution's life without parole sentencing request in David Reed's upcoming trial was denied Tuesday by Kosciusko Circuit Court Judge Rex Reed.
David Reed is accused of murdering his two sons in a 1998 house fire at 9816 Majestic Way, Marinelane Gardens, Syracuse.
The fire was ruled an arson by the state fire marshal's office and Reed was indicted by a grand jury on two counts of murder for the deaths of Austin, 2, and Justin, 1, in 2002.
Reed is set to go to trial April 26.
