A road vacation that appeared before the Kosciusko County Area Plan Commission earlier this month appeared before the Kosciusko County Commissioners this morning but was tabled.
During the plan commission's Aug. 4 meeting, they heard from attorney Richard Helm, representing Judy Jordan.
When a road is vacated it ceases to be a public road where the public has the right to travel.
The original plat for the subdivision Jordan lives in at Yellow Creek Lake had a roadway that has never been developed that runs through her property.
Other parts of that "drive" have been vacated in the past.
Among other things, during the plan commission meeting, Helm and the plan commission disagreed over whether vacating that drive would deny access of the public to Yellow Creek Lake.
Helm contended that Jordan's property rights extended to the lake and that the public didn't have access to the lake through her property.
That discussion continued today in front of the commissioners with Helm and Area Plan Director Dan Richard present.
Attorney Mike Miner, who advises the commissioners, tended to agree with Helm's stance while Richard cited that county attorney Mike Reed sided with the plan commission.
There also was some confusion on differences between the plat and what is shown on the county's global imaging system that is accessed through the county's website, kcgov.com
After a 45-minute discussion, the request for vacation was tabled until the next commissioner's meeting, Aug. 31 at 9:15 a.m.
During that time, Richard said he and his staff will research the area and bring more accurate information to the commissioners.
County Administrator Ron Robinson informed the commissioners of the $1,582,330 Indiana Department of Transportation grant the county has received for phase four of the Western Route Project.
The commissioners also approved the county health department's lowest bid to demolish the property at 33 EMS B62 Lane. The lowest bid was for $1,900.
Whenever the property is sold, the county will receive the money from the sale.
County Highway Superintendent Dennis Pletcher requested that CR 150W, north of CR 300N, near Madison Elementary have its speed limit lowered to 35 mph. The commissioners approved the request.
The commissioners also approved the highway department to petition the county's drainage board concerning tile at CR 275E near Stonehenge Golf Club.
The county commissioners are Bob Conley, Brad Jackson and Ron Truex.
