Two rezoning and two vacation requests before the Kosciusko County Commissioners went smoothly and quickly Tuesday.
Though he was not present Tuesday, Dennis L. Replogle's petition was to rezone 5.76 acres from an agricultural district to a residential district.
The property is on the south side of CR 1250N and north of Beer Road in Van Buren Township.
In June, Replogle's petition to rezone the property from Ag to an Ag 2 district was continued by the commissioners until Replogle had a chance to petition to rezone it residential.
His petition to rezone the property to residential was approved by a vote of 5 to 3 by the Kosciusko County Area Plan Commission July 5. Previously, the plan commission denied his petition to rezone it to Ag 2.
The area plan commission is only a recommending board to the county commissioners.
Tuesday, the commissioners could vote to rezone it residential, agricultural 2 or deny the petitions. Commissioners Eddie Creighton and Brad Jackson approved rezoning it Ag 2, which was Replogle's original request.
The property is separate from another piece of property Replogle owns that is zoned residential.
The rezoning of the property west of Turkey Creek to residential was approved with the promise by Replogle that a restrictive covenant be placed on it. A restrictive covenant prevents future property owners from complaining about agricultural property in the area.
Hahn Auction Service will auction off the property for Replogle.
In other business:
Dennis Paternoster petitioned to rezone 2.29 acres from a residential district to an agricultural district. The property is on the south side of CR 1290N, on the west side of CR 825E in Turkey Creek Township.
Attorney Steve Snyder, representing Paternoster, said his client wants to place mini-storage units on the property.
Use and drainage of the property will be reviewed by the Kosciusko County Board of Zoning Appeals, Area Plan Director Dan Richard told the commissioners.
The petition was approved.
The commissioners approved the vacation request by James and Jennifer Crosley. The alley being vacated is in the Epworth Forest area between lots 11 and 13.
"It will not affect any access to any lots and we have no major objections to this," said assistant area plan commission director Matt Sandy.
Snyder, representing the Crosleys, said, "It essentially doesn't go anywhere," and his clients have no use for the alley between their properties. People most affected by it being vacated have no objection to the vacation.
There were no remonstrators.
A vacation request by Jim and Janie Combs also was approved. The property is north of Silver Lake corporate limits, off Myrtle Glen Road.
There were no remonstrators to the petition.
