District supervisor Angie Mucker spoke to the Warsaw Code Enforcement hearing officer on behalf of Long John Silver Seafood Shoppe and franchise owner Ronald Switzer Monday concerning the code violations of the restaurant.
The restaurant is at 2601 E. Center St.
Long John Silver received a list of code violations Oct. 18 concerning mostly electrical and fire separation problems.
Mucker said a reinspection has been scheduled for Monday.
Long John Silver had a fire in June and hearing officer Larry Clifford said he's worried about the potential fire hazards. According to Mucker, the problems are being taken care of.
"It sounds like you just need a new inspection," said Clifford.
He imposed a civil penalty of $1,000 to be postponed until Monday at 2 p.m. If the restaurant does not pass the inspection at that time, the penalty will come into effect.
In other business:
Apartment A at 214 Fort Wayne Ave., belonging to Ralph and JoEllen Fitch, still isn't under complete compliance.
At last month's code enforcement hearings the duplex was ordered shut down until the necessary repairs are made. Fitch received a civil penalty of $1,000 for willful noncompliance.
Assistant building commissioner and building inspector Pam Kennedy said Fitch has not scheduled an inspection since the last hearing. However, she did say the cockroaches in Apartment A are almost gone and Fitch has been painting. The roof is still the same. The roof materials were not installed properly.
Apartment B was not discussed because of a clerical error.
Clifford imposed a civil penalty of $1,000, to be postponed until Dec. 22.
The main problems at 505 Alward St. are the water heater and the furnace.
Bart Holle is living on the property and buying it on land contract from Doug Kehler.
Holle is in the process of making the place livable. The barn on the property has a roof that needs to be replaced. Holle is using the barn for storage.
The pilot on the furnace won't stay lit so Holle lights it himself, Kennedy said. The pipeline is galvanized and debris from the pipeline could lead to a gas leak. Kennedy said the galvanized pipe should be replaced because it plugs up the gas line.
Clifford was worried about the house burning down. He gave Holle until April 10 to fix the garage, Dec. 5 to fix the water heater and Dec. 15 to fix the furnace. Otherwise Holle will be forced off the property.
"I want to impart to you how potentially dangerous this is," Clifford said.
No civil penalty was imposed.
Dennis Schaaff of 612 W. Wilson St. received a civil penalty of $250 to be postponed until Dec. 15.
The main problem with the building on the property is the foundation. It doesn't line up with the sill plate.
Kennedy said everything else on the property is 85 percent compliant.
