Rape Convict Gets 200 Years

Posted
The man convicted of brutally raping a woman in 2005 will spend the rest of his life in prison.

Monday afternoon in Kosciusko Superior Court, Judge Duane Huffer sentenced Shawn Lester Hattery to 200 years in prison for 16 felony counts, including one count of burglary, one count of battery, three counts of criminal confinement, one count of attempted deviate sexual conduct, three counts of rape, three counts of sexual battery, two counts of deviate sexual conduct, one count of obstruction of justice and one count of theft.During the sentencing, Huffer said he was taught to find the good in everyone, but Huffer could not find anything good about Hattery.

A 12-person jury found Hattery guilty of all 16 charges in a four-day trial in November.

On Oct. 5, 2005, Hattery broke into the apartment of a 21-year-old Rose-Hulman Institute of Technology student who was in Warsaw for an internship at Zimmer.

Hattery then bound and raped the woman multiple times before leaving her tied to her own bed.

The woman immediately went to the hospital, and a rape kit was performed and sent for DNA testing.

Once the DNA sample came back from a testing lab in Nashville, Tenn., the information was put into an offender database, the Convicted Offender DNA Index System. No match was found initially in CODIS, but when Hattery was convicted of a different crime and put in prison in 2008, he was required to submit a DNA sample. That's when the match occurred.

Once Hattery's name came up as a match in CODIS, police met with him and obtained an evidenciary sample that was re-tested and also matched the sample from the rape kit.

Hattery did not speak during the sentencing in Kosciusko Superior Court Monday; however, he plans to appeal the case, and David Kolbe was assigned to be his attorney.

With the 200-year sentence, Hattery's earliest release date would be Jan. 4, 2110.
