Ransbottom Wins Judgment

Ransbottom Landfill can accept out-of-state trash and the local zoning board must say it's so, according to a judgment rendered Monday in Kosciusko Superior Court I.

In his ruling, Judge Duane Huffer agreed with Ransbottom's claim that the ban was unconstitutional. A lawsuit seeking to lift the ban was filed in November, and the Kosciusko County Board of Zoning Appeals said in December that it would not fight the case.

The provision prohibiting bringing out-of-state trash into the landfill was actually nullified by a U.S. Supreme Court decision five years ago. However, since the ban was still on local books, proper documentation had to be made before it could legally be lifted.

Huffer ordered the BZA to remove the condition from Ransbottom at its next regularly scheduled meeting.
