Property Restrictions Slow Efforts

Efforts by Winona Restoration Company to develop a resort-type park in Winona Lake, as well as to build a restaurant, may be hampered by restrictions that accompany some of the property involved.

Because the property was previously owned by the Presbyterian Assembly, some of the deeds forbid such practices as possessing or selling "alcoholic or intoxicating drinks of any kind for beverage purposes"; selling cigarettes or narcotics; or gambling and games of chance.

Restrictions also include fairly confining rules regarding noise: "The operation of radios, phonographs or any disconcerting or noise making instrument of any kind, singing, music, loud talking, laughter or the making of any other unnecessary noise that disturbs or tends to disturb the quietude and tranquility of the Winona sanctuary. ..."

Likewise, walking to and from the beaches "without robes or other appropriate garments covering the body, and bathing without modest attire" also is prohibited, as is the use of unnecessarily loud motor vehicles or boats.

One piece of property, Dane Miller said, even has a restriction against taking photographs on Sunday.

Miller and Brent Wilcoxson are working with attorneys to change the restrictions, but it is time-consuming and painstaking work.
