Planners Continue Vacation Request

Area Plan Commission moved to continue a road vacation request after a request by the petitioner to table the hearing came just one day before the hearing.

The request is to vacate a portion of undeveloped road that leads to Beaver Dam Lake.

The road is used as public access to the lake by those who live in the neighborhood.

Videotape taken by Area Plan Director Dan Richard showed that a portion of it is currently blocked by a camper.

This matter previously appeared before the county commissioners Sept. 28 but was continued because it had yet to appear before the plan commission.

The petitioner, who wasn't named during Wednesday's meeting, is represented by Jay Lavender, according to Richard.

On Tuesday, a neighbor, Teresa Terisini, and her daughter-in-law were on hand to voice their opposition to the proposed vacation.

Terisini said she uses the public access to get to a pier.

Terisini said she had flown in for the meeting and was previously at the commissioners meeting.

Richard said he feared that due to the postponements of the hearing it would cause there to be less and less people present who are against the vacation.

There were about 10 people at the Sept. 28 commissioners meeting.

With that said, however, Richard said it was the policy of the plan commission to allow one hearing continuance.

Richard noted that there were remonstrators' statements and a petition with 22 names on file for the hearing.

The plan commission voted for four rezoning requests Wednesday.

Those favorable recommendations will be sent to the county commissioners Oct. 26 at 9:15 a.m.

Larry Hoffer's request to rezone 17.6 acres from a residential district to an agricultural district on the west side of EMS B1 Lane in Tippecanoe Township was approved.

The purpose of the rezoning, according to attorney Steve Snyder, is to eventually open up a deer farm. There will be no hunting on the farm.

Robert Williamson petitioned to rezone 5.803 acres of land from Industrial II to a commercial district.

The land is on the east side of Ind. 13 in Tippecanoe Township.

Attorney Bob Reed represented Williamson and said the rezoning was to eventually move Triple T grocery store into that location.

Tarah and Samuel Weaver had their rezoning request approved to turn 1.75 acres from commercial to residential.

They currently have their home on that property at the corner of CR 350E and Pleasant Grove Drive in Wayne Township.

Tarah Weaver said they bought the property as commercial but had no intention of ever using it for that purpose.

Scott and Sara Miller asked for and were given a favorable recommendation to rezone 5.773 acres of land on Old 30, 4,700 feet west of CR 450E in Lake Township, from agricultural to residential.

The move would allow building another home on that tract of land.

One neighbor, David Zimmerman, said he was concerned that the tract would have mobile homes put on it.

Snyder, who was also representing the Millers, said the plan was to build just one single-family home.

Dr. Vladimir Murzin's vacation request near his home at Palestine Lake was approved. Murzin owns all the land on the peninsula where he lives and asked that a road that ends near his home be vacated.

Murzin asked for the road to be vacated because people were driving on his property to reach the lake.

Since he owns all the land to the lake there was no issue of public access.

Attorney Richard Helm said his client, Murzin, would probably erect a fence to keep people from driving on his property.

Washington Township brought a road vacation request before the plan commission Wednesday afternoon as well.

The vacation was given a favorable recommendation to end CR 350S where it runs past the Pierceton Cemetery.

Attorney Mike Miner said the reason for the vacation request was because of a planned expansion of the cemetery.

The plan commission also issued a favorable recommendation to a vacation request on Wright Place in the Lakeview Park neighborhood on the north side of Lake Wawasee.

A final plat was approved for Triple A development which will add another home at the property on 8754 W. Hepton Road, Nappanee.

Both North Winds and Camelot Lake subdivisions were given permission to put up signs.

After all regular business, the board discussed procedures for erosion control in the county.

An update was also given about plan commission president Vic Virgil.

Virgil was absent from Wednesday's meeting as he is recovering from surgery to remove a cyst from his brain.

According to Dan Richard, Virgil is in good spirits.
