Both petitions before the Kosciusko County Area Plan Commission Wednesday received approval with 6-to-1 votes.
Emma Jean Line asked to rezone property from a commercial to a residential district. The property is on the north side of Crow Road and 150 feet west of East Wawasee Drive in Turkey Creek Township.
Larry Line said they wanted to rezone it residential so they can build a new home on it. There were no remonstrators to the petition.
Charlie Haffner, plan commission vice chairman, said the two properties on either side of the Line property are zoned commercial. If the commission allowed the Line property to go to residential, there would be a residential zoning between two commercially zoned properties.
Dick Kemper, county surveyor and plan commission member, said the Line property already is being used as residential and the Lines are going to enhance the property.
Haffner was the sole plan commission member voting against the rezoning.
On rezonings, the plan commission is only a recommending board to the county commissioners, who have final approva. Lines' petition will go before the commissioners June 15 at 9:30 a.m. in the county courthouse, Warsaw.
The only plan commission member voting against Kyle Newcomer's petition for a preliminary plat approval for a residential development on 20.3 acres was Kelly Easterday. She did not indicate why she voted against the petition.
The property is on the west side and one-fourth-mile south of CR 900N and CR 500E in Turkey Creek Township.
Previously, the plan commission had recommended to the county commissioners that Newcomer's petition to rezone the property to residential from agricultural be denied. However, after hearing the petition, the commissioners approved to rezone his property with a deed restriction that none of the three lots can be further subdivided. Newcomer accepted that term and the deed includes that restriction.
Remonstrator Jeremy Sponseller and his wife expressed concern that the lots would be further subdivided and they did not want that to happen. Plan commission member Kevin McSherry explained the deed restriction again and added that the homes had to be a minimum of 1,500 square feet and cannot be manufactured housing.
Members of the plan commission present Wednesday included Kemper, Easterday, Don Arms, Hal Strong, McSherry, Haffner and Larry Coplen; not present were Norm Lovell and chairman Vic Virgil. The board meets at 1 p.m. in the Justice Building meeting room on the first Wednesday of every month.
