Plan Commission To Review Plat For Subdivision Approval

Posted

A Warsaw family is seeking approval to subdivide a lot to construct a home and sell off a remaining lot.

The Warsaw Plan Commission will meet tonight to discuss the plat approval at its meeting.

Applicants John and Susan Handel are requesting final plat approval at 1810 N. Bay Drive.

The commission approved preliminary plat approval at its Sept. 11 meeting.

The applicants are requesting to subdivide lot one in North Bay Drive into two equal-size lots of 0.29 acres.

The proposed split meets the zoning requirement for lot width and lot size. The irregular-shaped lot on the lake has adequate street frontage to meet the 70-foot lot width requirement. The lot size of the approximately 12,500 square feet exceeds the requirement of 8,750 square feet.

The commission also will hear a request from property owner Mark Fox, APT Holding LLC, to vacate a public right of way at 501 Argonne Road.

The proposed vacation of public right of way on Lakeview Boulevard currently is unimproved by Warsaw and the city does not have utilities within the right of way.

Indiana American Water currently uses the right of way access off of Argonne Road in order to deliver goods to its treatment facility, and Indiana American Water has two waterlines that occupy the existing right of way.

City Planner Jeremy Skinner said in a letter to the commission he is not opposed to vacating the right of way and replacing it with a utility easement, but said it would not be beneficial to the property owner.

He said he is concerned with Indiana American Water's ability to continue to deliver goods to their treatment facility. He said there are alternative routes for the delivery trucks, but they may have trouble entering and exiting the property.

Skinner is recommending the commission pass an unfavorable recommendation to the city council for the vacation of the public right of way, unless Indiana American Water and the property owner can work out an agreement that would be beneficial to both of them.

The commission also will review a map amendment to the zoning ordinance for 21 acres along Husky Trail and Patterson Road from applicant Menards Inc.

The commission will vote to submit the map amendment to the city council for approval.

The Warsaw Traffic Commission reviewed a traffic-impact analysis at its Nov. 2 meeting regarding a proposed commercial and residential development east of the intersection of Parker Street, Husky Trail and Patterson Road.

Menards Inc. is requesting to rezone approximately 21 acres from R-1 residential to C-3 commercial in order to accommodate the development of a Menards store with additional commercial lots.

The remaining property to the west will be zoned R-1 residential for a future single-family residential development.

The proposed rezoning will add an additional 21 acres of commercial property to the existing 20 acres of commercial property in order to provide the necessary space to accomplish the plan's objectives.

In order to address the traffic issues within the area, it is essential to adjust the zoning boundaries to accommodate the road lengthening of Parker Street, shifting Husky Trail and Patterson Road to the East and widening both Husky Trail and Patterson Road to accommodate future traffic and traffic controls.

It also will allow the development space to promote adequate buffering in terms of trees and mounding, as well as residential developments to those areas adjacent to existing residential developments.

The commission will meet tonight at 7 p.m. at city hall.
