No-Rabb Inc. withdrew its petition late Wednesday afternoon for a new beer, wine and liquor permit for a package mart in Winona Lake, excise officer Pat Fleck said at Thursday's Kosciusko County Alcoholic Beverage Commission meeting.
She said the withdrawal was made to the state commission. She did not receive notice until late Wednesday night and could not notify anyone of it in advance.
At March's ABC meeting, Fleck told the petitioner, Jason Nolin, that Class D felony charges may be filed against him with the county prosecutor.
On his application for a permit for a package mart at 2302 E. Winona Ave., Winona Lake, Nolin answered "no" to a question about whether he was ever charged with a misdemeanor. However, he did have a misdemeanor charge on his criminal record.
Nolin then told Fleck that attorney Vern Landis filled out the application for him. But, Fleck said, at the beginning of the meeting when she read Nolin the questions and asked if he had filled out the application, he said he had. The application itself did not indicate that an attorney filled the application out, she said.
No charges have been filed against Nolin in the case.
The petition was continued until the legal ramifications could be worked out.
The hearing for the petition in March brought out several dozen remonstrators, along with petitions against the permit.
In another matter Thursday, the ABC continued a new retailer permit for beer and wine and Sunday sales for Wawasee Golf Club until the May 3 meeting at 2 p.m. They had 17 of the needed 30 signatures needed for a permit.
A new beer, wine and liquor retailer permit was approved for Bennigan's in the Ramada Plaza at 2521 E. Center St., Warsaw. The establishment is expected to be open in May.

Kosciusko County ABC meets at 2 p.m. in the county courthouse, Warsaw, on the first Thursday of each month. Members are Fleck, president Darwin Call, Kenneth Johnson and Gordon Vanator.
