NOTICE OF PUBLIC HEARING UPON PETITION FOR VACATION OF A PUBLIC RIGHT OF WAY (STREETS AND ALLEYS) CITY OF WARSAW, INDIANA 1ST SOURCE BANK, PETITIONER NOTICE IS HEREBY GIVEN that 1st Source Bank, as Petitioner, has filed a Petition to Vacate a Public Right of Way with the Common Council for the City of Warsaw, Indiana seeking the vacation of a public alley. A copy of the Petition is on file with the City Planning office and the Common Council. The Petition has been set for hearing before the Warsaw Common Council on the 4th day of May, 2015 at 7:00 p.m. The hearing will be held in the Warsaw City Hall, Council Chambers at 102 S. Buffalo Street, Warsaw IN 46580. The public way for which vacation is sought is situated in Warsaw, State of Indiana and more particularly described as follows: A 16.5-foot wide alley lying between Lots Numbered 284 and 285 in the Original Plat of the Town, now City of Warsaw, Indiana, as recorded in Plat Book 1 page 1 in the Office of the Recorder of Kosciusko County, Indiana, more particularly described as follows, to wit: BEGINNING at a 5/8-inch iron pin capped "Walker" found at the Northwest corner of said Lot Number 285; thence S89°-33’-34”E, on and along the North line of said Lot Number 285, a distance of 132.00 feet to a railroad spike found at the Northeast corner of said Lot Number 285; thence N00°-05’-26”E, a distance of 16.50 feet to a 5/8-inch iron pin capped "Walker" found at the Southeast corner of said Lot Number 284; thence N89°-33’-34”W, on and along the South line of said Lot Number 284, a distance of 132.00 feet to a 5/8-inch iron pin capped "Walker" found at the Southwest corner of said Lot Number 284; thence S00°-05’-26”W, a distance of 16.50 feet to the point of beginning, containing 0.050 acres of land, more or less, subject to all legal right-of-way, subject to all legal drainage easements and all other easements of record. ANY PERSON desiring to be heard may file objections or comments with the Warsaw Common Council, and any person may appear at such hearing and be heard in support or objection of the Petition.
