Terry and Connie Holzheuer, represented by attorney Rick Helm, were assessed a $1,000 civil penalty postponed until Feb. 5 for the code violations at 303 S. Indiana Street.
Warsaw building inspector Pam Kennedy said at the Warsaw Code Enforcement hearings Monday the property is in 20 percent compliance. There are five apartments, four occupied and one vacant with eviction proceedings in process.
Hearing officer Larry Clifford imposed the civil penalty with postponement under the agreement that apartment 1 will remain vacant until it passes inspection.
Helm also spoke on behalf of the Holzheuers for property at 1410 E. Center St. This case was postponed at the last meeting until Dec. 29. The owners would like an extension for the roof repairs because of the weather.
Kennedy said besides the roof, the door still needs to be fixed. She suggested the extension be granted only for the roof. Clifford extended the date until Jan. 31 for the roof and left the date for the door at Dec. 29.
In other business:
Attorney Steve Snyder represented Laura Stutzman of 731 E. Fort Wayne St. He mentioned the property has dozens of issues and asked Clifford to postpone any action.
Stutzman is currently pursuing action against the previous owners of the property. She was at the September hearing on the property and said she never got a disclosure list with the house when she bought it.
In September Clifford told her she has numerous code violations in the three apartments of the house. He said she is still responsible for bringing the property into compliance, but she may have a claim against the seller for selling her a house with so many code violations and not giving her a disclosure list. He told her to see a lawyer.
Clifford agreed to postpone action and the case was continued.
Helm represented Sydney Martin of 612 W. Wilson St. and asked for an extension on the deadline for repairs. Helm said the repairs on the house were supposed to be done by Dec. 15, but due to some bad advice and work, Martin was unable to get the repairs done.
Clifford said he would extend the date for the house repairs until Dec. 31 and the garage repairs until March 30.
Donald and Laura Bixel of 212 S. Union St. received a code violation list on Aug. 6 on all three apartments.
Kennedy said the last inspection was Aug. 8. The Bixels said everything is finished but the bathroom in apartment B and they should have that done in 30 days.
Clifford imposed a $500 civil penalty to be postponed until Jan. 31.
Lance and Janie Martinez are buying the property at 215 Ra-Mar Drive and are closing the deal this week.
They have been working on tearing up the roof of the house and they've been dropping the shingles on the ground because they didn't have a dumpster. The neighbors have been complaining about the environmental issue.
Clifford ordered the mess cleaned up by Jan. 2 now that the Martinezes have a dumpster. If the shingles aren't cleaned up by that date, the city will clean it up then bill the Martinezes.
Kennedy said she wasn't happy with the electrical work done at 213 Ra-Mar Drive owned by Rick and Jewell Craft.
Electrician Eddie Hatfield represented the Crafts and gave an update on the electrical work done at the property.
Clifford said his list shows there are five electrical problems and one gas problem.
Hatfield said the electrical issues were taken care of and he was informed by the owners that the gas issue was taken care of too. The property now needs an inspection.
Kennedy said the property is in 95 percent compliance.
Clifford imposed a $500 civil penalty to be postponed until Jan. 12 with respect to these six items.
