ORDINANCE NO. 2008-06-04 AN ORDINANCE ESTABLISHING RESPONSIBILITY FOR THE MAINTENANCE OF TREE LAWNS WHEREAS, the Town Council has considered the issue of the responsibility for the maintenance of Tree Lawns within the Town of Claypool, Indiana, and the appropriateness of providing guidance with respect to the responsibility for same; and, WHEREAS, the Town Council wishes to provide for this responsibility via Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CLAYPOOL, INDIANA: Section 1. That the Tree Lawn shall be defined as that area of land located between the paved portion of any Town street, alley, or other right-of-way, and the property line of the adjoining real estate not owned by the Town of Claypool. Section 2. That the owner or occupant, as the case may be, of the adjoining privately owned real estate shall be responsible for the maintenance of the Tree Lawn. This maintenance includes, but is not limited to, mowing of the grass, removal of trash, the trimming of trees or bushes, and the like. Section 3. All parts of Ordinances in conflict herewith are hereby repealed. Section 4. This Ordinance shall be in full force and effect from and after its passage and due publication as provided by law.
