ORDINANCE NUMBER 1992-4 AN ORDINANCE CORRECTING ORDINANCE NUMBER 1992-1 AN ORDINANCE ESTABLISHING CURFEWS WHEREAS, the Town Council has reviewed Ordinance Number 1992-1 an ordinance establishing curfews, and has determined that by omission, Said ordinance does not provide a curfew for Friday evenings and Saturday mornings; and WHEREAS, the Town Council wishes to correct said omission and to adopt a new ordinance establishing curfews which provides a curfew for each evening as originally intended; and WHEREAS, the Town Council has reviewed the provisions of I.C, 31-6-4-2 providing curfews applicable throughout the State of Indiana; and WHEREAS, the Town Council has decided that the curfews established in I.C, 31-6-4-2 are later than are reasonable for the public safety under the conditions now existing in the Town of Claypool, Indiana; and WHEREAS, the Town Council believes that the curfews should be advanced within the jurisdiction of the Town of Claypool, Indiana, by up to two (2) hours to adequately provide for the public safety of the citizens and visitors of the Town of Claypool, Indiana; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CLAYPOOL, INDIANA; ARTICLE ONE (a) It is a curfew violation for a child fifteen (15), sixteen (16), and seventeen (17) years of age to be in a public place; (1) between 11:00 p.m., Friday and 6:00 a.m., on Saturday or between 11:00 p.m., Saturday and 6:00 a.m., on Sunday; (2) after 10:00 p.m. on Sunday, Monday, Tuesday, Wednesday, or Thursday; or (3) before 6:00 a.m. on Monday, Tuesday, Wednesday, Thursday, or Friday. (b) It is a curfew violation for a child under fifteen (15) years of age to be in a public place after 10:00 p.m. or before 6:00 a.m.. on any day. (c) This article does not apply to a child who is: (1) accompanied by his parent, guardian, or custodian; (2) accompanied by an adult specified by his parent, guardian, or custodian; or (3) participating in, going to, or returning from: (A) lawful employment; (B) a school sanctioned activity; or (C) a religious event. ARTICLE TWO The violation of Article One shall constitute a curfew violation under I.C. 31-6-4-1, or any acts amendatory thereto, and shall Subject violator to the penalties provided in I.C. 31-6-4-1 et seq., or any acts amendatory thereto. ARTICLE THREE This Ordinance shall supersede the provisions of Ordinance Number 1992-1 when It becomes effective. and this Ordinance shall be in full force and effect from and after its passage and after due publication as provided by law.
