ORDINANCE NUMBER 2008-06 AN ORDINANCE AMENDING ORDINANCE NUMBER 1992-4 AN ORDINANCE ESTABLISHING CURFEWS WHEREAS, the Town Council has reviewed Ordinance Number 1992-4 an ordinance establishing curfews, and WHEREAS, the Town Council wishes to provide appropriate penalties for the violation of Ordinance Number 1992-4; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF CLAYPOOL, INDIANA; SECTION ONE A person who violates Ordinance Number 1992-4 is in violation of a separate offense for each day or part of a day during which the violation is committed. The penalty for the first violation of Ordinance Number 1992-4 shall be Fifteen Dollars ($15.00). The penalty for a second violation of Ordinance Number 1992-4 shall be Thirty Dollars ($30.00). The penalty for a third and subsequent violation of Ordinance Number 1992-4 shall be Fifty Dollars ($50.00). The parents, or guardians, as the case may be, of a minor who violates Ordiance Number 1992-4 shall be jointly and severally liable for the penalty imposed for such violation upon the third or subsequent offense. In addition to the fines assessed for a violation of Ordinance Number 1992-4, any person who violates Ordinance Number 1992-4 shall also be responsible for, and shall pay, any and all costs and attorney fees incurred by the Town in enforcing Ordinance Number 1992-4, including but not limited to, any costs and attorney fees incurred in the filing and prosecution of an action for violation of Ordinance Number 1992-4 in any appropriate Court of law. SECTION TWO All parts of Ordinances in conflict herewith are hereby repealed. SECTION THREE This Ordinance shall be in full force and effect from and after its passage and after due publication as provided by law.
