UNITED STATES DISTRICT COURT NORTHERN

DISTRICT OF INDIANA SOUTH BEND DIVISION

UNITED STATES OF AMERICA, Plaintiff,

v.

KOREY L. SLONE and COMMUNITYWIDE FEDERAL CREDIT UNION,

Defendants.

CAUSE NO. 3:17-CV-181-PPS-JEM

ORDER

This matter is before the Court on a Motion for Service by Publication  [DE 10], filed by the Government on June 7, 2017.  Under 28 U.S.C. § 1655 and Federal Rule of Civil Procedure 4, the Government requests that the Court issue an Order authorizing service by publication and ordering Defendant Korey L. Slone to appear in this case and respond to the Government's Complaint.

This is an action to enforce a real property lien on a parcel located in Kosciusko County, Indiana, within this district, and particularly described as follows:

THE NORTH 100.0 FEET OF OUTLOT NUMBER 22 IN TUCKER, MYERS AND HACKEDORN'S ADDITION TO THE TOWN OF MENTONE, KOSCIUSKO COUNTY, INDIANA.

This parcel is commonly  known as 521 N. Morgan Street, Mentone, IN 46539. Counsel for the Government  represents that service on Defendant Slone is impracticable because, despite due diligence, counsel for the Government  does not know where Defendant  is.

In light of counsel for the Government's representations and consistent  with 28 U.S.C. § 1655, the Court hereby GRANTS the Motion for Service by Publication  [DE 10] and ORDERS that this Order be published  in a newspaper of general circulation  in Kosciusko  County, Indiana, once a week for six consecutive weeks, beginning no later than twenty-eight days from the date of this Order.

The Court further ORDERS Defendant  Korey L. Slone to appear or plead concerning the Government's Complaint  in  this  action  on  or  before fourteen days  from  the  last  date  of publication. If Defendant  Slone does not appear or plead within the time allowed, the Court will proceed as if Defendant Slone had been served with process, which may include entering default against Defendant Slone on the Government's claims.

SO ORDERED this 9th day of June, 2017.
