SUMMONS BY PUBLICATION AND NOTICE TO UNNAMED FATHER STATE OF INDIANA SS: COUNTY OF KOSCIUSKO IN THE MATTER OF THE ADOPTION OF INFANT MALE CALEB JOSIAH HANN. IN THE KOSCIUSKO COUNTY CIRCUIT COURT ADOPTION DOCKET 43C01-1101-AD-1 TO: This Summons and Notice is to THE UNNAMED PUTATIVE FATHER of the child born to Kathryn Elizabeth Hann on the 27th day of November, 2010, or who claims to be the father of the child born to Kathryn Elizabeth Hann on the 27th day of November, 2010, and to any other person who may be concerned. You are notified that a petition for adoption of the child was filed in the office of the Clerk of Kosciusko Circuit Court, 121 North Lake Street, Warsaw, Indiana 46580, by which the Petitioners Brian Nicholson and Elizabeth A. Nicholson seek to adopt said child. YOUR ARE NOTIFIED that if the unnamed putative father seeks to contest the adoption of the child, the unnamed putative father must file a motion to contest the adoption in accordance with I.C. 31-19-10-1 in the above named court or a paternity action under I.e. 31-14 within thirty (30) days after the last notice of this action is published. This notice shall be served by publication. YOU ARE FURTHER NOTIFIED that if the unnamed putative father: (1) Does not file: (A) A motion to contest the adoption; or (B) A paternity action under I.C. 31-14; within thirty (30) days after the last notice of this action is published; or (2) After filing a paternity action under I.C. 31-14, fails to establish paternity; the above named court shall hear and determine the petition for adoption, and the unnamed putative father's consent will be irrevocably implied; and the unnamed putative father will lose the right to contest the adopt or the validity of the unnamed putative father's implied consent to the adoption; and the unnamed putative father will lose the right to establish paternity of the child under I.C. 31-14. Nothing Kathryn Elizabeth Hann or any one else says to the unnamed putative father of the child relieves the unnamed putative father of his obligations under this notice. Under Indiana law, a putative father is a person who is named or as claims that he may be the father of a child born out of wedlock but who has not yet been legally proven to be the child's father. This notice complies with I.C. 31-19-4-4 but does not exhaustively set forth the unnamed putative father's legal obligations under the Indiana adoption statutes. A person being served with this notice should consult the Indiana adoption statutes. Dated February 3rd, 2011. Jason McSherry, Clerk Circuit Court of Kosciusko County Paul D.
