NOTICE TO PUTATIVE FATHER IN THE KOSCIUSKO SUPERIOR COURT 1 KOSCIUSKO COUNTY, INDIANA IN THE MATTER OF THE ADOPTION OF MAYA MARLEE REYES JOSE FRANCISCO REYNALDO GUEVARA, Petitioner CAUSE NO. 43D01-1206-AD-24 Published Notice to Roque Reyes who has been named the father of the child born to Erika Xique (now Erica Xique Guevara) on December 24, 2006, is notified that a Petition for Adoption of the child was filed in the office of the Clerk of the Kosciusko Superior Court 1 on June 28, 2012. On said date, Petitioner also filed a praecipe for summons along with supporting affidavit showing that diligent search has been made and that Roque Reyes cannot be located. If Roque Reyes wishes to contest the adoption of the child, the putative father must file a paternity action to establish his paternity in relation to the child not later than thirty (30) days after the receipt of this notice. If Roque Reyes does not file a motion to contest the adoption or a paternity action under IC 31-14 within thirty (30) days after service of this notice, or after filing a paternity action under IC 31-14 fails to establish paternity within a reasonable period as described by the paternity court under IC 31-14-21-9 through IC-31-14-21-11, then the above-named court will hear and determine the Petition for Adoption. His consent will be irrevocably implied, and he will lose his right to contest either the adoption or the validity of his implied consent to the adoption. He will lose his right to establish his paternity of the child under IC 31-14. Nothing Erika Xique Guevara or anyone else says to Roque Reyes relieves Roque Reyes of his obligations under this notice. Under Indiana law, a putative father is a person who is named as or claims that he may be the father of a child born out of wedlock but who has not yet been legally proven to be the child's father. For purposes of this notice, Roque Reyes is a putative father under the laws in Indiana regarding adoption. This notice does not exhaustively set forth the putative father's legal obligations under the Indiana statutes.
