NOTICE OF SUIT SUMMONS BY PUBLICATION STATE OF INDIANA SS COUNTY OF KOSCIUSKO NATIONSTAR MORTGAGE, LLC, Plaintiff v. KYLE J. GILBERTSON, ANGELA M. GILBERTSON, ALLIANCE FUNDING, A DIVISION OF SUPERIOR BANK, F.S.B, CITY OF WARSAW, MIA FUNDING, LLC, UNKNOWN OCCUPANT(S), Defendants IN THE KOSCIUSKO SUPERIOR COURT CAUSE NO. 43D03-0809-MF-926 To: Alliance Funding, a Division of Superior Bank, F.S.B., BE IT KNOWN, that Nationstar Mortgage, LLC, the above-named Plaintiff, by its attorney, Zarksis, V. Daroga, has filed in the office of the clerk of the Kosciusko Superior Court its Complaint against the above-named Defendant, and the said Plaintiff having also filed in said Clerk's office the affidavit of a competent person showing that the residence and whereabouts of the Defendant, Alliance Funding, a Division of Superior Bank, F.S.B, upon diligent inquiry is unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Kosciusko County, State of Indiana, to wit: Commencing at the northwest corner of lot number 451 in the original plat of the Town, now City of Warsaw, and running thence south 132 feet to the alley; thence 43 1/2 feet to the east line of the sellers lot; thence north 132 feet to Fort Wayne Street; thence east 43 1/2 feet to the place of beginning, being a part of lot number 498 in Funk's Addition to the town, now City of Warsaw, as recorded in plat book 1, page 6 in the Office of the Recorder of Kosciusko County, Indiana. Commonly known as 423 West Fort Wayne Street, Warsaw, IN 46580. NOW, THEREFORE, said Defendant is hereby notified of the filing and pendency of said Complaint against them and that unless he appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against him for the relief demanded in the Complaint.
