NOTICE OF SUIT
From the State of Indiana to Daniel Robert Shroyer all his heirs, devisees, legatees, successors, and assigns and any other person who may be concerned: You are notified that you have been sued in the Court and action above named. The nature of the suit is for declaratory judgment and to quiet title to the following described real estate:
6' wide walk between Lots 19 and 20 in Waw-Wil-A-Way Park as recorded in Plat Record 3, page 277, and found the last deed of record to be a Quitclaim Deed from Lou H. Haymond, Trustee to Daniel Robert Shroyer dated April 27, 1945 and recorded April 27, 1945 in Deed Record 157, page 500. Said walkway and plat lies within the East Half of the Northwest Quarter of Section 25, Township 33 North, Range 6 East in Kosciusko County, Indiana.
This Summons by Publication is specifically directed to all the living heirs, devisees, legatees, successors and assigns of Daniel Robert Shroyer, who may have a claim or interest in the above-described real estate.
In addition to the above named Defendants being served by this Summons, there may be other Defendants who have an interest in this lawsuit.
If you have a claim for relief against the Plaintiff arising from the same transaction or occurrence, you must assert it in your written answer.
You must answer the Complaint in writing by you or your attorney, or before thirty (30) days after the third published Notice of Suit, and if you fail to do so, a judgment will be entered against you for what the Plaintiff, Elizabeth A. Draving, the surviving Co-Trustee of the Leonard R. Draving and Elizabeth A. Draving Joint Revocable Living Trust dated July 26, 2004, has demanded in the Complaint.
