NOTICE OF SUIT STATE OF INDIANA SS: COUNTY OF KOSCIUSKO WELLS FARGO BANK, N.A., NOT IN ITS INDIVIDUAL CAPACITY BUT AS TRUSTEE TO THE RMAC REMIC TRUST, SERIES 2009-4, Plaintiff vs. MARVIN SCHMUCKER and CATHY SCHMUCKER, Defendants IN THE KOSCIUSKO COUNTY SUPERIOR COURT CAUSE NO. 43D03-1008-MF-698 The State of Indiana to the defendants above named, and any other person who may be concerned. You are notified that you have been sued in the Court above named. The nature of the suit is the foreclosure of a mortgage upon the property located in Kosciusko County at 10029 N. 500 W., Milford, IN 46542, legally described as: Commencing at the southeast corner of the southeast quarter of section 21, township 34 north, range 5 east; thence north 16 rods; thence west 10 rods; thence south 16 rods; thence east 10 rods to the lace of beginning. The above described tract also being more particularly descried as follows, to wit: the east 165.0 feet of the south 264.0 feet of the southeast quarter of section 21, township 34 north, range 5 east, Kosciusko County, Indiana, more particularly described as follows, to wit: beginning at the southeast corner of said southeast quarter; thence north, on and along the east line of said southeast quarter, being within the right-of-way of County Road 500W, a distance of 264.0 feet (16 rods); thence westerly, by an interior angle of 90 degrees 30 minutes and parallel to the south line of said southeast quarter, a distance of 165.0 feet (10 rods); thence south and parallel to said east line, a distance of 264.0 feet (16 rods) to a point on said south line; thence easterly, on and along said south line, being within the right-of-way of County Road 1000N, a distance of 165.0 feet (10 rods) to the point of beginning, containing 1.000 acres of land. (hereafter "Real Estate').
