You are notified that you have been sued in the Court above named. The nature of the suit against you is: Complaint on Note and to Foreclose Mortgage on Real Estate Against the property commonly known as 3940 S. Elaine Dr. Warsaw, IN 4 6580-6273 and described as follows: Lot number twelve (12) in Candlewood Estates Phase 1, as recorded in Plat Book 12, page 88, in the Office of the Recorder of Kosciusko County, Indiana and also the northwest part of lot number eleven (11) in said Candlewood Estates Phase-1, said northwest part being more particularly described as follows-beginning at an iron pin marking the westerly corner of said lot #11 and lot #12 and thence north 66 degrees 37 minutes 05 seconds east, along the northerly line of said lot #11 224.6 feet to an iron pin at the northerly corner of said lot #11; thence south 31 degrees 29 minutes 20 seconds east, along the easterly line of said lot #11 22.88 feet to an iron pin; thence south 44 degrees 17 minutes 31 seconds west 241.07 feet to an iron pin on the easterly right-of-way of Elaine drive; then northerly, along said easterly right-of-way and along a curve to the right, 118.77 feet, said curve having a radius of 125.00 feet, a delta angle of 54 degrees 26 minutes 30 seconds and a chord of 114.36 feet at north 25 degrees 54 minutes 29 seconds west, to the point of beginning. This summons by publication is specifically directed to the following named defendant(s): Mark N. Morris, Mortgage Electronic Registration Systems, Inc., as nominee for American Home, Mortgage and Helvey and Associates. Inc. This summons by publication is specifically directed to the following named defendant(s) whose whereabouts are unknown: The Unknown Heirs and Devisees of Desmond Jackson, deceased. If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer or response. You must answer the Complaint in writing, by you or your attorney, within thirty (30) days, March 26, 2010, after the Third Notice of Suit, and if you fail to do so a judgment by default may be entered against you for the relief demanded by the Plaintiff.
