ITS MANAGING MEMBER, C/O HOMEQ SERVICING CORPORATION, Defendants IN THE KOSCIUSKO SUPERIOR COURT - CIVIL DIVISION CAUSE NO. 43D03-0904-MF-447 The State of Indiana to the defendants above named, any other person who may be concerned. You are notified that you have been sued in the above named Court. The nature of the suit against you is Complaint on Note and to Foreclose Mortgage on the following described real state in Kosciusko County: A tract of land in the southeast quarter of section 30, township 32 north, range 6 east, Kosciusko County, Indiana, better described as follows, to wit: Commencing at the south quarter post of said section 30; thence north, a distance of 705 feet to a point; thence north 89 degrees 53 minutes east, a distance of 345.3 feet; thence north 01 degrees 28 minutes east, a distance of 239.3 feet; thence north 08 degrees 18 minutes east, a distance of 186.8 feet; thence north 00 degrees 51 minutes east, a distance of 159.5 feet; thence north 05 degrees 07 minutes east a distance of 271.6 feet; thence north 01 degrees 11 minutes east, a distance of 158.1 feet; thence north 08 degrees 51 minutes west, a distance of 160 feet to a point; thence east, a distance of 175 feet to an iron pipe, marking the place of beginning; thence east, a distance of 155.8 feet to a point; thence south, a distance of 150 feet to a point on the north line of Maple Crest Street; thence west, a distance of 150.8 feet to an iron pipe; thence north 01 degrees 55 minutes west, a distance of 150.1 feet to the place of beginning. This Summons by publication is specifically directed to the following defendants whose addresses are: Monument Street Funding, LLC, by Centurion Funding, Inc. its managing member c/o HomeEq Servicing Corporation, c/o Highest Executive Officer Present, 1100 Corporation Center Drive, Raleigh, NC 27607 and to the following named defendants whose whereabouts are unknown: Gene O. Farrar, Lisa A. Farrar In addition to the above-named defendants being served by this summons there may be other defendants who have an interest in this law suit. If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer. You must answer the Complaint in writing, by you or your attorney, on or before July 23, 2009 (same being within thirty (30) days after the Third Notice of Suit) and if you fail to do so a judgment will be entered against you for what the plaintiff has demanded.
