BRITO, CAPITAL ONE BANK AND THE UNKNOWN OCCUPANT, Defendants IN THE KOSCIUSKO SUPERIOR COURT CAUSE NO. 43D03-0904-MF-371 The State of Indiana to the defendants above named, any other person who may be concerned. You are notified that you have been sued in the Court named above. The nature of the suit against you is: Foreclosure of real estate mortgage on: A tract of land locate in the State of Indiana, County of Kosciusko, Township of Turkey creek, City of Syracuse, being a portion of Section 5, township 34 north, range 7 east, bounded on the east by Lake Street and on the south by Pearl Street and more fully described as follows, to wit: The east forty-four (44) feet of lot number sixty-one (61) in the original plat of Syracuse, as recorded in plat book 2, page 159, in the Office of the Recorder of Kosciusko, Indiana. This summons by publication is specifically directed to the following named defendants whose addresses are follows: John R. Brito, 4840 N. Baldwin R. N., Webster, IN 46555; Capital One Bank (USA), NA, c/o Highest Officer Found 15000 Capital One Drive Attn: 63001-0125, Richmond, VA 23238; The Unknown Occupant, 1722 E. Illinois St., Evansville, IN 47711; and to the following defendant whose whereabouts is unknown: Sandra A. Brito In addition to the above named defendants being served by this summons there may be other defendants who have an interest in this lawsuit. If you have a claim for relief against the plaintiff arising from the same transaction of occurrence, you must assert it in your written answer. You must answer the Complaint in writing, by you or your attorney, within thirty (30) days after the Third Notice of Suit is published, and if you fail to do so, a judgment will be entered against you for what the plaintiff has demanded.
