NOTICE OF SUIT STATE OF INDIANA SS: COUNTY OF KOSCIUSKO LITTON LOAN SERVICING, LP, Plaintiff vs. SHAWN D. PICKETT, Defendants IN THE KOSCIUSKO CIRCUIT COURT CAUSE NO. 43C01-0906-MF-344 The State of Indiana to the defendants above named, any other person who may be concerned. You are notified that you have been sued in the Court above named. The nature of the suit against you is: Complaint on Note and to Foreclose Mortgage on Real Estate against the property commonly known as 24 EMS Lane R 4 D, Pierceton, IN 46562 and descried as follows: That part of lot number 13 in Riley Memorial Beach, section 1, township 32 north, range 7 east, more particularly described as follows: Commencing at the most southerly corner of lot number 31 and running thence in a northwest direction along the southwesterly side of said lot, a distance of 40 feet to the northwest corner thereof; thence in a northeasterly corner thereof; thence in a northeasterly direction along the northwesterly side of said lot, a distance of 44.55 feet to a point which is distant southwesterly 80 feet from the northeast corner of said lot; thence in a southwesterly direction to a point of the southeasterly side of said lot which is distant southwesterly 80 feet from the southeast corner of said lot; thence in a southwest direction along the southeasterly line of said lot a distance of 51.96 feet to the place of beginning excepting therefrom; part of lot number 13 in Riley Memorial Beach as recorded in the plat thereof in the Office of the Recorder of Kosciusko County, Indiana, more particularly described as follows: Commencing at the northwest corner of said lot; thence in a northeasterly direction along the northwesterly side of said lot, a distance of 31.3 feet to the point of beginning; thence continuing northeasterly along said line a distance of 13.25 feet to a point which is distant southwesterly 80 feet from the northeast corner of said lot; thence in a southeasterly direction to a point on the southeasterly side of said lot which is distant southwesterly 80 feet from the southeast corner of said lot; thence in a southwesterly direction along the southeasterly line of said lot a distance of 8.06 feet to a point; thence northwesterly a distance of 47.3 feet to the point of beginning. This summons by publication is specifically directed to the following named defendant(s) whose whereabouts are unknown: Shawn D. Pickett If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer or response. You must answer the Complaint in writing, by you or your attorney, within thirty (30) days, December 3, 2009, after the Third Notice of Suit, and if you fail to do so a judgment by default may be entered against you for the relief demanded by the Plaintiff.
