NOTICE OF SUIT STATE OF INDIANA SS: COUNTY OF KOSCIUSKO MIDFIRST BANK, Plaintiff vs. JIMMIE D. JAMES, JR., ANGELA RENEE JAMES, JOHN DOE, JANE DOE, Defendants IN THE KOSCIUSKO SUPERIOR COURT CIVIL DIVISION CAUSE NO. 43D03-0903-MF-262 The State of Indiana to the defendants above named, any other person who may be concerned. You are notified that you have been sued in the above named Court. The nature of the suit against you is: Complaint on Note and Foreclose Mortgage on the following described real estate in Kosciusko County: Exhibit "A" Tract 1: A tract of land in the northwest quarter of section 8, township 30 north, range 6 east, Lake Township, Kosciusko County, Indiana, more particularly described as follows: Beginning at the southeast corner of lot number 94 in Sells Addition to Silver lake, as recorded in plat book 3, page 372, in the Office of the Recorder of Kosciusko County; thence north 01 degree 29 minutes 00 seconds east along the east line of said lot number 94, 36.00 feet to an iron pin; thence north 90 degrees 00 minutes 00 seconds east parallel with the north line of said lot number 94, 12.00 feet to an iron pin; thence north 01 degree 29 minutes 00 seconds east parallel with the east line of said lot number 94, 30.00 feet to an iron pin on the south side of an alley; thence north 90 degrees 00 minutes 00 seconds east along the extended north line of said lot number 94, 14.06 feet to an iron pin; thence north 01 degree 29 minutes 00 seconds east parallel with the east line of said lot number 94, 11.98 feet (recorded 11.88 feet) to an iron pin on the south line of lot number 67 in said Sell's Addition; thence north 90 degrees 00 minutes 00 seconds east along the south line of lot number 67 and lot number 68 in said Sell's Addition, 97.02 feet (recorded 1.47 chains) to an iron pin; thence south 01 degree 29 minutes 00 seconds west, 195.50 feet (recorded 12 rods) to an iron pin on the westerly extended south line of outlot number 1 in Eli Batemans Addition of outlots as recorded in plat book 3, page 371 in the Office of the Recorder of Kosciusko County; thence north 90 degrees 00 minutes 00 seconds east along said extended south line of outlot number 1 and the south line of said outlot number 1, 130.54 feet to an angle-iron post; thence south 00 degrees 06 minutes 00 seconds west, 393.22 feet (recorded 392.2 feet) to an iron pin; thence north 89 degrees 09 minutes 00 seconds west, recorded bearing and used as the basis of bearings herein, along the south line of the Kerlin Farms property as recorded in document 94-12-1131 in the Office of the Recorder of Kosciusko County, 263.03 feet to an iron pin at the southeast corner of the KZO, LLC Property as recorded in document 200500010337 in the Office of the Recorder of Kosciusko County; thence north 01 degree 29 minutes 00 seconds east along the east line of said KZO, LLC Property, 506.93 feet (recorded 506 feet) to the point of beginning, containing 2.86 acre, more or less. TRACT II: The west 43.5 feet to the following described tract of land, to wit: Commencing at the northwest corner of outlot number one (1) in Eli Bateman's Addition to the Town of Silver Lake; thence running west 6 rods; thence south 12 rods; thence east 6 rods; thence north to the place of beginning, being a grant in the north half of the west half of the northwest quarter of section 8, township 30 north, range 5 east. This Summons by publication is specifically directed to the following defendants whose addresses are: John Doe, 201 South High Street, Silver Lake, IN 46982 Jane Doe, 201 South High Street, Silver Lake, IN 46982 and to the following named defendants whose whereabouts are unknown: Jimmie D. James, Jr., Angela Renee James In addition to the above-named defendants being served by this summons there may be other defendants who have an interest in this lawsuit. If you have a claim for relief against the plaintiff arising from the same transaction or occurrence, you must assert it in your written answer. You must answer the Complaint in writing, by you or your attorney, on or before June 13, 2009 (same being within thirty (30) days after the Third Notice of Suit) and if you fail to do so a judgment will be entered against you for what the plaintiff has demanded.
