To the defendants named below herein, and any other person who may be concerned.
You are notified that you have been sued in the Court named above.
The nature of the suit is the foreclosure of a mortgage upon the property located in Kosciusko County at 2554 State Road 13 N., Pierceton, IN 46562, legally described as:
A TRACT OF LAND IN THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 34, TOWNSHIP 33 NORTH, RANGE 7 EAST, TIPPECANOE TOWNSHIP, KOSCIUSKO COUNTY, INDIANA, BEGINNING AT THE SOUTHEAST CORNER OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 34, TOWNSHIP 33 NORTH, RANGE 7 EAST AND RUNNING THENCE AS FOLLOWS: NORTH 7 DEGREES WEST 103 FEET TO AN ELM TREE; NORTH 40 1/2 DEGREES WEST 166 FEET TO A TRIPLE ASH TREE; THENCE NORTH 70 DEGREES WEST 375.7 FEET TO AN OAK TREE ON THE EAST LINE OF STATE ROAD 13; THENCE SOUTH 34 DEGREES WEST 420.6 FEET ALONG THE SAID LINE TO AN IRON PIPE OF THE HALF SECTION LINE; THENCE EAST 721 FEET ON THE EAST AND WEST HALF SECTION LINE OF SAID SECTION TO THE PLACE OF BEGINNING, CONTAINING 3.78 ACRES, LESS AND EXCEPTING THEREFROM THE FOLLOWING DESCRIBED TRACT, TO WIT:
BEGINNING AT AN IRON PIPE AT THE INTERSECTION OF THE EAST RIGHT OF WAY LINE OF INDIANA STATE ROAD NO. 13 AND THE SOUTH LINE OF SAID SECTION 34 AND RUNNING THENCE NORTH 32 DEGREES 35 MINUTES EAST 180 FEET ALONG SAID EAST RIGHT OF WAY LINE OF INDIANA STATE ROAD NO. 13 TO AN IRON PIPE, THENCE SOUTH 75 DEGREES 18 MINUTES EAST 495.5 FEET TO AN IRON PIPE ON THE SOUTH LINE OF SAID SECTION 34; THENCE WEST ALONG SAID SECTION LINE 576.2 FEET TO THE PLACE OF BEGINNING AND CONTAINING 1.0 ACRES MORE OR LESS. SUBJECT TO ALL HIGHWAYS. (hereafter “Real Estate”).
This summons by publication is specifically directed to the following defendants who may claim some interest in the Real Estate and whose whereabouts are not known with certainty: Robert J. Evanatz, Deceased, and His Heirs-At-Law, Devisees, Legatees, Descendants, Personal Representatives, Executors, Trustees, and Administrators
You must respond to this summons by publication, by you or your attorney, on or before thirty (30) days after the Third Notice of Suit has been published. If you fail to do so, a default judgment may be entered against you for the relief demanded in the Complaint.
