NOTICE OF SHERIFF'S SALE OF REAL ESTATE By virtue of a judgment and decree of foreclosure, a copy of which has been duly issued, certified and to me directed by the Clerk of the Kosciusko Circuit Court in the certain cause bearing Cause Number 43C01-0811-MF-589 upon the docket of said Court, wherein Mutual Bank f/n/a Mutual Federal Bank is the plaintiff and James J. Bohlin, Jane A. Richardson-Bohlin and James J. Bohlin DDS Professional Corporation are defendants, requiring me to make the aggregate sum of Four Hundred and Fifty-Seven Thousand Six Hundred Thirty-Five and 69/100 ($457,635.69) for payment of the judgments of said plaintiff against the defendants, James J. Bohlin, Jane A. Richardson-Bohlin and James J. Bohlin DDS Professional Corporation with interest thereon from the date of said decree, namely, August 5, 2009, at the rate and with costs provided by law as therein provided and ordering the sale of real estate hereinafter described to make assets for the payment of said judgment and decree, I will expose and offer for sale at public auction to the highest bidder on Tuesday, the 11th day of January, 2011, at the hour of 3:30 o'clock p.m., E.S.T., at the Office of the Sheriff of Kosciusko County, in the Kosciusko County Jail in Warsaw, Indiana, the following-described real estate situate in Kosciusko County, Indiana, to-wit: TRACT I: The South Half of the Northeast Quarter of Section 12, Township 32 North, Range 7 East. LESS AND EXCEPT the following two descriptions: 1. Commencing at the Southeast corner of the above described real estate and running thence West on the South line thereof 78 rods; thence North 42 rods; thence East 78 rods; thence South on the East line of said 80 acre tract of land 42 rods to the place of beginning. 2. Part of the South half of the Northeast Quarter of Section 12, Township 32 North, Range 7 East, Kosciusko County, Indiana, more particularly described as follows, to wit: Commencing at a railroad spike found marking the Southeast corner of said Northeast Quarter; thence North, on and along, the East line of said Northeast Quarter, a distance of 872.47 feet to an iron pin at the true point of beginning; thence continuing North, on and along said East line, being within the right-of-way of County Road 1000 East, a distance of 387.7 feet to an iron pin; thence Westerly, by an interior angle of 91 degrees 12 minutes 40 seconds, a distance of 897.93 feet; thence South, by an interior angle of 88 degrees 47 minutes 20 seconds, a distance of 388.65 feet; thence Easterly, by an interior angle of 91 degrees 09 minutes, a distance of 897.91 feet to the true point of beginning. The aforesaid sale of real estate will be made without any relief from valuation or appraisement laws and without any right of redemption. The terms of said sale will be cash.
