NOTICE OF SHERIFF'S SALE OF REAL ESTATE By virtue of a judgment and decree of foreclosure, a copy of which has been duly issued, certified and to me directed by the Clerk of the Kosciusko Circuit Court in the certain cause bearing Cause Number 43C01-1004-MF-218 upon the docket of said Court, wherein Mutual Bank is the plaintiff and James Joseph Hamilton, Karin M. Hamilton and United States of America (Internal Revenue Office), are defendants, requiring me to make the aggregate sum of Four Hundred and Fifty Thousand Seven Hundred Seventy-Four and 71/100 Dollars ($450,774.71) for payment of the judgment of said plaintiffs against the defendants, James Joseph Hamilton and Karin M. Hamilton, with interest thereon from the date of said decree, namely, May 25, 2010, at the rate and with costs provided by law as therein, and ordering the sale of real estate hereinafter described to make assets for the payment of said judgment and decree, I will expose and offer for sale at public auction to the highest bidder on Tuesday, the 21st day of September, 2010, at the hour of 3:30 o'clock p.m., E.S.T., at the Office of the Sheriff of Kosciusko County, in the Kosciusko County Jail in Warsaw, Indiana, the following-described real estate situate in Kosciusko County, Indiana, to-wit: Lots Numbered Forty-three (43) and Forty-four (44) in the First Addition to the Plat of Yarnelle Point, as recorded in Plat Book 1, page 92, in the Office of the Recorder of Kosciusko County, Indiana. Together with all that portion of a vacated twenty-foot street lying adjacent to the Northwesterly side of Lots Forty-three (43) and Forty-four (44) in the First Addition to the Plat of Yarnelle Pointe, as set out in Ordinance Number 92-6-2, recorded June 24, 1992, as Instrument No. 92-06-1147, in the Office of the Recorder of Kosciusko County, Indiana, and being more particularly described as follows, to-wit: A tract of land located in the Southwest Quarter of Section 16, Township 32 North, Range 6 East, 2nd P.M., Wayne Township, Kosciusko County, Indiana, more particularly described as follows: Commencing at an iron pipe at the most Northerly corner of the First Addition to Yarnell Point; thence South 61 degrees 20 minutes 30 seconds East, along the Northeast line of said Addition, 10.00 feet to the point of beginning; thence continuing South 61 degrees 20 minutes 30 seconds East, along said South line, 20.00 feet; thence South 28 degrees 39 minutes 30 seconds West, along the North line of Lots 41 through 46 in the First Addition to Yarnell Point, 286.85 feet; thence Northerly, along a curve to the right, 34.60 feet, said curve to the right, 34.60 feet, said curve having a radius of 101.04 feet and subtended by a chord North 06 degrees 51 minutes 26 seconds West, 34.43 feet; thence North 28 degrees 39 minutes 30 seconds East, 258.83 feet to the point of beginning. LESS AND EXCEPTING THEREFROM the following described tract: A tract of land located in the Southwest Quarter of Section 16, Township 32 North, Range 6 East, Wayne Township, Kosciusko County, Indiana, being a part of Lot 43 and adjacent tract in the First Addition to Yarnelle Point, more particularly described as follows: Beginning at the Northwest corner of Lot 42; thence South 65 degrees 26 minutes 30 seconds East 90.30 feet, more or less, to the shoreline of Winona Lake; thence South 18 degrees 22 minutes 45 seconds West, on and along the said shoreline, 6.76 feet, more or less; thence North 61 degrees 13 minutes 11 seconds West, on and along the North line of Lot 42,91.28 feet, more or less to the Point of Beginning. The above-described real estate for information purposes only is located at 1127 Country Club Lane, Warsaw, Indiana 46580. The aforesaid sale of real estate will be made without any relief from valuation or appraisement laws and without any right of redemption therefrom. The terms of said sale will be cash.
