NOTICE OF SHERIFF'S SALE OF REAL ESTATE By virtue of a judgment and decree of foreclosure, a copy of which has been duly issued, certified and to me directed by the Clerk of the Kosciusko Circuit Court in the certain cause bearing Cause Number 43C01-0911-MF-571 upon the docket of said Court, wherein David J. Weidenbenner and Michelle M. Weidenbenner are the plaintiffs and Ryan D. Weidenbenner, Angelika S. Weidenbenner and National City Bank are defendants, requiring me to make the sum of Eighty-four Thousand Four Hundred Forty-two and 70/100 Dollars ($84,442.70) for payment of the judgment of said plaintiffs against the defendants, Ryan D. Weidenbenner and Angelika S. Weidenbenner, with interest thereon from the date of said decree, namely, December 15, 2009, at the rate and with costs provided by law as therein, and ordering the sale of real estate hereinafter described to make assets for the payment of said judgment and decree, I will expose and offer for sale at public auction to the highest bidder on Tuesday, the 16th day of February, 2010, at the hour of 3:30 o'clock p.m., E.S.T., at the Office of the Sheriff of Kosciusko County, in the Kosciusko County Jail in Warsaw, Indiana, the following-described real estate situate in Kosciusko County, Indiana, to-wit: Beginning at a corner stone at the Northwest corner of the Southwest Quarter of Section 10, Township 32 North, Range 6 East; running thence South 100 feet; thence East 220 feet; thence North 100 feet to the Half Section line; thence West 220 feet to the Place of Beginning, now included within the corporate limits of the City of Warsaw. LESS AND EXCEPTING THEREFROM: Commencing at the Northwest corner of the Southwest Quarter of Section 10, Township 32 North, Range 6 East; thence North 88 degrees 22 minutes 54 seconds East (Bearing Basis GPS) along the North line of the Southwest Quarter of Section 10 a distance of 20.6 feet to the intersection of East right-of-way line of Parker Street and the South right-of-way line of South Drive also being the Point of Beginning; thence North 88 degrees 22 minutes 37 seconds East along the South right-of-way line of South Drive also being the North line of the Southwest Quarter of Section 10 a distance of 29.1 feet; thence South 78 Degrees 52 minutes 31 seconds West, 29.6 feet to the East right-of-way line of Parker Street; thence North 00 degree 21 minutes 30 seconds West, 4.9 feet to the Point of Beginning. The above-described real estate for information purposes only, is located at 4340 North Parker Street, Warsaw, Indiana 46580. The aforesaid sale of real estate will be made without any relief from valuation or appraisement laws and without any right of redemption therefrom. The terms of said sale will be cash.
