NOTICE OF SHERIFF'S SALE OF REAL ESTATE By virtue of a judgment and decree of foreclosure, a copy of which has been duly issued, certified and to me directed by the Clerk of the Kosciusko Circuit Court in the certain cause bearing Cause Number 43C01-0806-MF-287 upon the docket of said Court, wherein Mutual Bank f/n/a Mutual Federal Savings Bank is the plaintiff and David W. Wentzel, Susan K. Wentzel, Terry L. Tucker, Sandra K. Tucker and Cavalry Portfolio Services, LLC are defendants, requiring me to make the sum of One Hundred Three Thousand Five Hundred Twenty-Six and 72/100 Dollars ($103,526.72) for payment of the judgment of said plaintiff against the defendant, David W. Wentzel and Susan K. Wentzel, husband and wife with interest thereon from the date of said decree, namely, August 18, 2008, at the rate and with costs provided by law as therein provided with any excess to be applied to the amounts owed Terry L. Tucker and Sandra K. Tucker, husband and wife, and Cavalry Portfolio Services, LLC in the amounts and order of priority as provided in said decree, and ordering the sale of real estate hereinafter described to make assets for the payments of said judgment and decree, I will expose and offer for sale at public auction to the highest bidder on Tuesday, the 28th day of October, 2008, at the hour of 3:30 o'clock p.m., E.S.T., at the Office of the Sheriff of Kosciusko County, in the Kosciusko County Jail in Warsaw, Indiana, the following-described real estate in Kosciusko County, Indiana, to wit: Lot Numbered Thirty-eight (38) in Southbrook Park - Section III, as recorded in Plat Book 7, page 84, in the Recorder's Office of Kosciusko County, Indiana. The above-described real estate for information purposes only, is located at 2448 S. Old Ditch Road, Warsaw, Indiana 46580. The aforesaid sale of real estate will be made without any relief from valuation or appraisement laws and without any right of redemption therefrom. The terms of said sale will be cash.
