Shumaker and Juanita J. Shumaker were the Plaintiffs, and Mark L. Snyder and Crystal Snyder are the Defendants, requiring me to make the sums as provided for in said Decree with interests and costs, I will expose to a public sale to the highest bidder, on the 23rd day of December, 2008, at the hour of 10:00 am (local time), or as soon thereafter as possible, at the Kosciusko County Sheriff's Department, Kosciusko County Justice Building, 221 West Main Street, Warsaw, Indiana, the interests of the Defendants in the following described real estate, commonly known as 1641 North 175 East, Warsaw, Indiana, 46582, together with all fixtures and improvements attached to said real estate, and more particularly described as follows: Part of the southwest quarter of the northeast quarter of section 3, township 32 north, range 6 east, Kosciusko County, Indiana, more particularly described as follows, to wit: Commencing at the northwest corner of the southwest quarter of the northeast quarter of said section 3; thence N88º-33'E, a deeded of 953 feet to a railroad spike found at the point of intersection of the centerline of County Road 175 E with the north right-of-way line of County Road 175N; thence S06º-27'W, on and along said centerline, a distance of 550.0 feet (recorded 545 feet) to a PK nail at a true point of beginning; thence N81º-44'W, a distance of 384.0 feet to an iron pin; thence S06º-27'W, a distance of 226.65 feet (recorded 227 feet) to a point on the centerline of McCarter Ditch (Deeds Creek); thence S81º-44E, on and along said ditch centerline, a distance of 384. feet to a PK nail at the point of intersection of said ditch centerline with the centerline of County Road 175E; thence N06º-27"E, on and along said centerline of County Road 175E; a distance of 226.65 feet (recorded 227 feet) to the true point of beginning; containing 2.00 acres of land, more or less, subject to legal right-of-way for County Road 175E, subject to all legal drain easements and all other easements of record. together with the rents, issues, income and profits therefrom.
