NOTICE OF SALE OF REAL ESTATE BY PRAIRIE TOWNSHIP In accordance with Indiana law, Prairie Township has identified a parcel of real estate as appropriate for sale and liquidation. The real estate is approximately one acre located north of County Road 300 North, and northeast of the intersection of County Road 300 North at County Road 350 West, and located at the southeast comer of a larger tract owned by Ronald and Marjorie Himes, as identified by Parcel ID #21-104-4 and by the legal description, in Kosciusko County, Indiana, as follows: A tract of about one (1) acre out of the Southwest comer of the following described real estate, formerly used for school purposes: Commencing at the Southeast comer of the Southeast Quarter of Section 26, Township 33 North, Range 5 East and running thence North 47 1/2 rods and 20 links; thence West to the North and South open line of said Section; thence South 47 1/2 rods and 20 links; thence East to the place of beginning. LESS AND EXCEPTING: A tract of land in the Southeast Quarter of Section 26, Township 33 North, Range 5 East in Kosciusko County, Indiana, and is more particularly described as follows; to wit: Commencing at the Southeast comer of the Southeast Quarter of Section 26, Township 33 North, Range 5 East and thence West along the South line of said Section 26 also being the centerline of County Road 300 North on an assumed bearing N. 90 degrees 00' 00" W a distance of 1759.13 feet to the point of beginning; thence continuing West bearing N. 90 degrees 00' 00"W, a distance of 245.0 feet; thence North bearing N. 00 degrees 00' 00"E. a distance of 266.7 feet; thence East bearing N. 90 degrees 00' 00"E. a distance of 245.0 feet; thence South bearing S. 00 degrees 00' 00"E. A distance of 266.7 feet to the point of beginning. The real estate is sold "as is" and this parcel is offered for the price of $220 if purchased by an abutting landowner pursuant to Indiana Code 36-1-11-5; and if not purchased by an abutting landowner, pursuant to the statutory requirements, by sale to the person who submits the highest offer for the tract except persons ineligible by operation of law. The discretion to accept or reject offers from persons who are not an abutting landowner is retained by the Township. All bids for the above-described real estate must be in writing, signed by the person offering, and accompanied by a certified check or money order in the amount of 10% of the bid. The certified check or money order will be applied to the price for the successful bidder. It will be returned to unsuccessful bidders. In the event that a successful bidder declines to complete the closing for the purchase of the tract, the 10% payment will be retained by the Township as liquidated damages. Buyer agrees to pay for all Closing, Recording Fees, Title Insurance, Legal and Advertising. Estimated to be a Total of $500.00 in addition to the price.
