SMITH, JOHN and CONNIE KAISER, and PAUL SIEBENMORGEN, as Agent for ASPIR INN LLC BEFORE THE TOWN COUNCIL OF WINONA LAKE, INDIANA YOU ARE HEREBY NOTIFIED that a petition has been filed with the Town Council of Winona Lake, Indiana by Virginia B. Smith Revocable Trust, Harold E. Smith, John and Connie Kaiser, and Paul Siebenmorgen as Agent for Aspir Inn LLC, requesting the vacation by ordinance of all of an alley platted in First Amended & Additional Plat to Winona Park, now Winona Lake between Lots 133, 134 and between Lot 134 and Lot 8 of Lawns of the Court, and more particularly described as follows: Right-of-way (alley) as platted in the First Amended & Additional Plat to Winona Park, now Winona Lake, more specifically beginning at the Southwest corner of Lot 133i thence North approximately 100 feet to the South boundary of Lot 7 of Lawns of the Court; thence 45 feet Westerly along the South border of Lot 8i thence South 20 feet to the North border of Lot 134i thence 30 Easterly to the Northeast corner of Lot 134i thence South 80 feet along the East border of Lot 134 to the Southeast corner of Lot 134i thence 15 feet Easterly to the point of beginning. This describes the alley lying West of Lot 133, South of Lot 7 and Lot 8, and North and East of Lot 134. YOU ARE FURTHER NOTIFIED that the Town Council of Winona Lake, Indiana, has set the petition for hearing at 6 p.m. on November 19, 2013, at the chambers of the Town Council, located in the Town Hall, 1310 Park Avenue, Winona Lake, Indiana. Any person may appear and be heard with regard to the petition at the time, date and place above scheduled for hearing or may send written comments or response to the Clerk-Treasurer of Winona Lake, Indiana, prior to the time and date set for hearing. After hearing the petition may be granted, denied or continued and an ordinance may be introduced and passed according to law, providing for the vacation of the right-of-way described in this notice. .
