TO THE CITIZENS OF KOSCIUSKO COUNTY, INDIANA You are hereby notified that a petition has been filed with the Common Council of the City of Warsaw, Indiana by Harvey L. Hayes and Lillie F. Hayes requesting the vacation by ordinance of a certain undeveloped and unimproved street located in North Lake Addition to the City of Warsaw, and more particularly described as follows: Part of William Street in North Lake Addition, Kosciusko County, Indiana, more particularly described as follows, to wit: Commencing at the Northwest corner of Outlot Number 3 in said North Lake Addition; thence S03°-15’-00”E (platted bearing and used as the basis of bearings for this description), on and along the West line of said Outlot Number 3, a distance of 458.46 feet to the Northwest corner of a certain tract of land as recorded in Document Number 2015091051 in the records of Kosciusko County, Indiana, said corner being situated 0.3 feet North of an iron pin found; thence continuing S03°-15’-00”E, on and along said West line, also being on and along the West line of said tract of land in Document Number 2015091051, a distance of 241.27 feet to an iron pipe found at the Southwest corner of said Outlot Number 3, said iron pipe also being at the Southwest corner of said tract of land in Document Number 2015091051, said iron pipe further being at the POINT OF BEGINNING; thence N59°-47’-33”E (recorded N49°-30’E), on and along a Southerly line of said tract of land in Document Number 2015091051, also being on and along a Northerly right-of-way line of said William Street, further being on and along the Southeasterly line of said Outlot Number 3, a distance of 173.03 feet (recorded 173.1 feet), to a corner of said tract of land in Document Number 2015091051, said corner being situated 0.2 feet South of an iron pipe found; thence N56°-40’-56”E (recorded N62°-59’E), on and along a Southerly line of said tract of land in Document Number 2015091051, also being on and along a Northerly right-of-way line of William Street, further being on and along the Southeasterly line of said Outlot Number 3, a distance of 282.31 feet (recorded 282.4 feet), to an iron pipe found at the Southeast corner of said tract of land in Document Number 2015091051, said iron pipe also being on the Southwesterly right-of-way line of Lake Street, said iron pipe further being at the Southeast corner of said Outlot Number 3; thence S35°-24’-48”E, on and along said Southwesterly right-of-way line, a distance of 50.03 feet to the Northeast corner of a certain tract of land as recorded in Deed Record 341 page 404 in said records, said corner being situated 0.6 feet Northwest of and 0.8 feet Northeast of an iron pipe found; thence S56°-40’-56”W (recorded S62°-59’W), on and along the Northwesterly line of said tract of land in Deed Record 341 page 404, also being on and along the Southeasterly right-of-way line of William Street, a distance of 285.49 feet (recorded 248.6 feet), to a 5/8-inch iron pin capped "Walker" at the Northwest corner of said tract of land in Deed Record 341 page 404, said iron pin also being at the Northeast corner of Outlot Number 2 in said North Park Addition; thence S59°-47’-33”W (recorded S49°-30’W), on and along a Northwesterly line of said Outlot Number 2, also being on and along a Southeasterly right-of-way line of William Street, a distance of 187.77 feet (recorded 184.9 feet), to a 5/8-inch iron pin capped "Walker" at a corner of said Outlot Number 2; thence S89°-46’-00”W (recorded S89°-48’W), on and along a North line of said Outlot Number 2, also being on and along the South right-of-way line of William Street, a distance of 511.52 feet to a 5/8-inch iron pin capped "Walker" at the Northeast corner of a certain tract of land as recorded in Document Number 200400006791 in said records, said iron pin being situated 200.00 feet East of the Northwest corner of said Outlot Number 2; thence N03°-15’-00”W, a distance of 50.07 feet to a 5/8-inch iron pin capped "Walker" on the North right-of-way line of William Street, said iron pin also being on the South line of a certain tract of land as recorded in Document Number 200700004100 in said records; thence N89°-46’-00”E (recorded N89°-48’E), on and along said North right-of-way line, also being on and along said South line, a distance of 500.77 feet to the point of beginning, containing 1.11 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and subject to all other easements of record. You are hereby notified that the Common Council of the City of Warsaw, Indiana, has set the above petition for hearing at 7:00 o’clock p.m., on May 16, 2016, at the City Hall, 102 South Buffalo Street, Warsaw, Indiana 46580. Any person may appear and be heard upon the petition at the time, date and place above scheduled for hearing and/or may send written comments or response to the Clerk-Treasurer of the City of Warsaw, 102 South Buffalo Street, Warsaw, Indiana 46580, prior to the above time and date set for hearing. After hearing, the petition may be granted, denied or continued, and an ordinance may be introduced and passed according to law, providing for the vacation of said real estate.
